PRINCIPAL COMMISSIONER OF INCOME TAX FARIDABAD vs. AVTAR KUKREJA
What did the High Court hold?
The High Court dismissed the revenue's appeals. It noted that similar appeals (ITA Nos. 92 and 94 of 2015 for assessment years 2004-05 and 2006-07) arising from the same ITAT order and raising similar issues had already been dismissed by the Court on 21.5.2015. In those dismissed appeals, the Court held that the findings of the ITAT were purely questions of fact, and therefore, no substantial question of law arose for consideration. Consequently, the present appeals were also dismissed on the same grounds. The Court did not delve into the merits of the ITAT's decision regarding the valuation of immovable properties or the AO's additions.
What were the facts?
The revenue, Principal Commissioner of Income Tax, Faridabad, filed appeals under Section 260A of the Income Tax Act, 1961, against the order dated 30.11.2010 passed by the Income Tax Appellate Tribunal (ITAT). The ITAT had allowed appeals for assessment years 2001-02, 2006-07, and 2007-08, and partly allowed for assessment years 2002-03 to 2005-06. The appeals arose from search and seizure operations conducted at the premises of the assessee, Sh. Avtar Kukreja, and his wife. Notices under Section 153A were issued, and returns were filed. The Assessing Officer (AO) made additions of ₹14,69,000/- on account of filing wrong/inaccurate particulars of income, based on a valuation by the Valuation Officer, after the assessee failed to file returns for 16 months post-search. The CIT(A) had dismissed appeals for assessment years 2001-02 to 2006-07 and partly allowed for 2007-08.
What were the issues?
1. On the facts and circumstances of the case and in law, whether the ITAT erred in deleting the addition made by the AO on the basis of valuation of immovable properties, considering that reference to a registered valuer was made only when details and value of properties were not verifiable and the assessee failed to file his return of income for 16 months after statutory notices following search and seizure. 2. On the facts and circumstances of the case and in law, whether the ITAT was justified in not accepting the valuation made by the registered valuer, who are competent authorities and made valuations based on approved rates. 3. On the facts and circumstances of the case and in law, whether the ITAT was justified in not accepting the valuation made by the registered valuer who followed due procedure, providing opportunities and considering submissions and evidence. Assessee's contentions: Not recorded in the judgment. Revenue's contentions: The revenue argued that the ITAT erred in deleting additions based on property valuation, especially given the assessee's delay in filing returns and the AO's reliance on a registered valuer when property details were unverifiable. The revenue also questioned the ITAT's justification for not accepting the registered valuer's valuation, which was based on approved rates and followed due procedure.
