What did the High Court hold?

The High Court held that no question of law arises from the order of the Income Tax Appellate Tribunal. The Court noted that the Commissioner of Income Tax (Appeals) and the Tribunal had analyzed the expenditure and the statutory provision under Section 40A(2)(b) and found that the requirements of the said provision were not fulfilled. Consequently, the Tax Appeal filed by the Revenue was dismissed. The reasoning implies that the ITAT's finding that the conditions for disallowance under Section 40A(2)(b) were not met was a finding of fact, and no substantial question of law was presented to the High Court for its consideration. The operative direction was the dismissal of the appeal.

What were the facts?

The Revenue, represented by the Principal Commissioner of Income Tax - 6, filed a Tax Appeal before the High Court of Gujarat at Ahmedabad. The appeal challenges an order passed by the Income Tax Appellate Tribunal (ITAT) dated July 13, 2017. The core of the dispute concerns the deletion of an addition made by the Assessing Officer (AO) on account of disallowance of expenses under Section 40A(2)(b) of the Income Tax Act, 1961. The AO had disallowed a portion of payments made by the assessee, Jagdish Process House, to sister concerns, deeming them excessive. The Commissioner of Income Tax (Appeals) and the ITAT had previously analyzed the expenditure and the relevant statutory provision.

What were the issues?

1. Whether the Appellate Tribunal has erred in law and on facts in deleting the addition on account of disallowance of expenses under Section 40A(2)(b) of the Act by not appreciating that the alleged reimbursement of expenses are payments to sister concerns by way of book adjustments and no credible evidence was submitted to prove that actual expenses were incurred? Assessee's Contention: The judgment does not record any specific contentions made by the assessee before the High Court. However, the fact that the ITAT deleted the addition implies that the assessee likely argued that the conditions for disallowance under Section 40A(2)(b) were not met and that the expenses were genuine and properly evidenced. Revenue's Contention: The Revenue argued that the Appellate Tribunal erred in deleting the addition. They contended that the alleged reimbursement of expenses were merely payments to sister concerns through book adjustments, and the assessee failed to provide credible evidence to prove that actual expenses were incurred, thus violating the provisions of Section 40A(2)(b).
