What did the High Court hold?

The High Court dismissed the Revenue's appeal. The Court referred to its own observations in a previous case involving the same assessee (Tax Appeal No. 655 of 2012) concerning the netting of interest for disallowance under Section 80IA. In that prior instance, the Court had noted the Supreme Court's decision in ACG Associated Capsules Pvt. Ltd. Vs. Commissioner of Income-Tax ([2012] 343 ITR 89 (SC)) concerning Section 80HHC, which held that only the net interest, excluding expenditure incurred in earning such interest income, should be considered. The High Court opined that the same principle would apply to deductions under Section 80IA. Therefore, the Tribunal had committed no error in allowing the claim for deduction under Section 80IA by considering the net interest. The operative direction was to dismiss the appeal.

What were the facts?

The Revenue, Principal Commissioner of Income Tax I, is in appeal against an order of the Income Tax Appellate Tribunal (ITAT) dated June 27, 2017. The appeal concerns the assessment year(s) not explicitly stated in the provided text. The dispute revolves around the claim for deduction under Section 80IA of the Income Tax Act, 1961, specifically concerning the netting of interest. This issue had previously arisen for the same assessee, Gujarat Paguthan Energy Corporation Pvt Ltd, in an earlier assessment year, Tax Appeal No. 655 of 2012. In that prior instance, the High Court had made observations regarding the netting of interest for disallowance under Section 80IA, referencing a Supreme Court decision.

What were the issues?

1. Whether the Appellate Tribunal has erred in law and on facts in allowing the claim for deduction under Section 80IA of the Income Tax Act, 1961, concerning the netting of interest. Assessee's Contentions: The judgment does not record specific contentions made by the assessee in this appeal. However, the reasoning in the previous Tax Appeal No. 655 of 2012 suggests the assessee would argue that only the net interest, excluding expenditure incurred in earning such interest income, should be considered for disallowance under Section 80IA. This aligns with the Supreme Court's decision in ACG Associated Capsules Pvt. Ltd. Vs. Commissioner of Income-Tax. Revenue's Contentions: The Revenue's appeal itself frames the issue as whether the Tribunal erred in allowing the deduction. The specific arguments of the Revenue are not detailed in the provided text.

Which sections of the Income-tax Act were involved?
