What did the High Court hold?

The Tribunal had allowed the assessee's appeals and quashed the proceedings under Section 153C. This was based on the finding that no incriminating material or evidence belonging to the assessee was detected as a result of the search conducted in the case of the Ridhi Siddhi Group. The Tribunal relied on the decision of this Court in CIT vs. Saumya Constructions Pvt Ltd. (380 ITR 429). The Revenue's counsel was unable to present any contrary arguments or evidence to challenge the Tribunal's findings. Therefore, the High Court held that the issue was squarely covered against the Revenue by the precedent set in Saumya Constructions Pvt Ltd. As no substantial question of law arose, the appeals filed by the Revenue were dismissed. The operative direction was the dismissal of the appeals.

What were the facts?

The Revenue has filed three Tax Appeals (Nos. 663, 664, and 674 of 2018) against common judgments and orders of the Income Tax Appellate Tribunal (ITAT). These appeals pertain to assessment years 2008-09, 2006-07, and 2009-10, respectively, and involve the same assessee, Siwana Agri Marketing Ltd. The ITAT had allowed the appeals preferred by the assessee, quashing and setting aside proceedings initiated under Section 153C of the Income Tax Act. These proceedings were based on a search conducted in the case of the Ridhi Siddhi Group. The assessments were initially confirmed by the CIT(A) but were later annulled by the ITAT.

What were the issues?

1. Whether the proceedings initiated under Section 153C of the Income Tax Act, 1961, were valid when no incriminating material or evidence belonging to the assessee was detected as a result of the search conducted in the case of a third party (Ridhi Siddhi Group)? (Question of law) Assessee's Contention: Not recorded in the judgment. Revenue's Contention: The learned counsel for the Revenue was unable to point out anything contrary to the factual matrix recorded by the ITAT or to the findings that additions were made without reference to incriminating material found as a result of search operations. The issue is squarely covered against the Revenue by this Court's decision in CIT vs. Saumya Constructions Pvt Ltd.
