ANVAY WAREHOUSING LLP vs. INCOME TAX OFFICER, WARD NO 43(1)
What did the High Court hold?
The Tribunal held that the impugned order dated April 30, 2022, passed under Section 148A(d), and the subsequent notice under Section 148 of the Income Tax Act, 1961, were not sustainable in law. The primary reasoning was the violation of the mandatory seven-day notice period stipulated in Section 148A(b) of the Act. The Assessing Officer's failure to provide adequate time for the petitioner to respond to the Section 148A(b) notice, and the subsequent ignoring of the petitioner's representation on this issue, rendered the proceedings invalid. The Tribunal set aside the impugned order and notice. The matter was remanded back to the Assessing Officer to pass a fresh order in accordance with the law. This fresh order must be a reasoned and speaking order, providing the petitioner an opportunity of hearing and considering their response to the notice under Section 148A(b), which the petitioner is to file within seven days from the date of the order.
What were the facts?
The petitioner, Anvay Warehousing LLP, challenged an order dated April 30, 2022, passed under Section 148A(d) of the Income Tax Act, 1961, and a subsequent notice under Section 148 of the Act. These actions related to Assessment Year 2015-2016. The challenge was based on a notice dated March 28, 2022, issued under Section 148A(b) of the Act, which allegedly provided insufficient time for response. The petitioner contended that Section 148A(b) mandates a minimum of seven days for response, but they were asked to respond by March 29, 2022, the very next day. This grievance was raised in a representation dated March 28, 2022, which the Assessing Officer allegedly ignored before passing the impugned order.
What were the issues?
1. Whether the notice issued under Section 148A(b) of the Income Tax Act, 1961, which provided less than the mandatory seven days for the assessee to respond, is contrary to law? (Question of law and fact, concerning Section 148A(b)) Assessee's Contentions: - The notice under Section 148A(b) was issued on March 28, 2022, and the petitioner was asked to respond by March 29, 2022, violating the minimum seven-day notice period mandated by Section 148A(b). - The Assessing Officer ignored the petitioner's representation dated March 28, 2022, highlighting this non-compliance. Revenue's Contentions: - The revenue's counsel was not in a position to contradict the petitioner's allegations regarding the violation of the statutory notice period under Section 148A(b) and the subsequent order under Section 148A(d).
