ATULT CHANDRA DAS,KOLKATA vs. DCIT,C.C-1(4), KOLKATA. , KOLKATA
What did the Tribunal hold?
The Tribunal held that considering the overall facts and circumstances, an estimation of profit at 1% of the undisclosed sales would be justified. For AY 2015-16, the Tribunal restricted the net profit to 1% of the undisclosed sales of Rs.48,76,62,397/-, thereby partly allowing the appeal. For AY 2016-17, the Tribunal directed the AO to take the net profit at 1% of the undisclosed sales of Rs.48,82,32,703/-, also partly allowing the appeal. Similarly, for AY 2017-18, the Tribunal directed the AO to take the net profit at 1% of the undisclosed sales of Rs.20,46,00,792/-, partly allowing the appeal. The ratio decidendi is that a reasonable estimation of profit, balancing the assessee's offered rate and the AO's higher estimation, is appropriate, and 1% is deemed fair in this context. No issue was expressly left undecided.
What were the facts?
The appeals were filed by the assessee, Atul Chandra Das, against the orders of the Ld. CIT(A) for Assessment Years (AYs) 2015-16, 2016-17, and 2017-18. The appeals for AYs 2016-17 and 2017-18 were filed with a delay of 81 days, which was condoned by the Tribunal. A search action on 09.12.2016 revealed unexplained cash deposits in the assessee's bank accounts, which the Assessing Officer (AO) treated as undisclosed sales. The assessee offered a net profit of 0.46% on these undisclosed sales in the return filed under Section 153A. The AO estimated the net profit at 1.50% based on prior years' data, and the Ld. CIT(A) confirmed this estimation. The dispute centers on the correct estimation of net profit on undisclosed sales.
What were the issues?
1. Whether the Tribunal was justified in estimating the net profit on undisclosed sales at 1.50% as against the assessee's offered rate of 0.46% for AY 2015-16, and consequently for AYs 2016-17 and 2017-18, under Section 250 of the Income-tax Act, 1961? Assessee's Contentions: - The assessee argued that the audited financial statement for AY 2015-16 was filed before the AO. - The net profit for AY 2013-14 was 0.60% and for AY 2014-15 was 1.27%. - The AO's estimation of profit for the year under consideration was on the higher side. Revenue's Contentions: - The judgment records no specific contentions for the revenue regarding the profit estimation, other than implicitly supporting the AO's and CIT(A)'s actions.
