What did the Tribunal hold?

The Tribunal allowed the appeals. For AY 2015-16, the Tribunal held that the notice u/s 148 dated 30.06.2022 was barred by limitation, referencing the Supreme Court's decision in Union of India vs. Rajeev Bansal, where the Revenue conceded that for AY 2015-16, all notices issued on or after 1st April 2021 would have to be dropped as they would not fall for completion during the period prescribed under TOLA. Consequently, grounds of appeal 1 to 4 concerning limitation and sanction were accepted, and the notice was set aside. Grounds 5 to 8 were left open. For AY 2016-17, the Tribunal found that the notice u/s 148 dated 30.06.2022 was issued beyond a period of three years. According to Section 151 of the Act, as interpreted by the Supreme Court in Rajeev Bansal, such a notice requires approval from a higher authority (PCCIT or CCIT). However, the approval was granted by the PCIT, which was deemed an inappropriate authority. Therefore, the notice was held to be invalid and set aside. Grounds of appeal 1 and 2 were accepted, and grounds 3 to 5 were left open. The operative direction for both appeals was to allow them.

What were the facts?

The assessee, Radhey Shyam Singhal, filed appeals against orders of the CIT(A)/NFAC for Assessment Years (AY) 2015-16 and 2016-17. These orders confirmed reassessment orders passed by the Assessing Officer (AO). For AY 2015-16, the AO assessed total income at Rs. 83,48,189/- after reopening based on information that sales of Rs. 3,42,45,867/- were made without actual movement of goods/services. For AY 2016-17, the AO made an addition of Rs. 52,46,161/-. The reassessment proceedings were initiated under Section 147 of the Income Tax Act, 1961, following directions from the Supreme Court in Union of India vs. Ashish Agarwal and CBDT instructions. The assessee contended that the notices issued under Section 148 were barred by limitation and lacked proper sanction.

What were the issues?

1. Whether the reassessment proceedings initiated by issuing notice u/s 148 for AY 2015-16 are barred by limitation as per Section 149 of the Act, considering the Supreme Court's decision in Union of India vs. Rajiv Bansal? 2. Whether the reassessment proceedings initiated by issuing notice u/s 148 for AY 2015-16 are bad in law due to the absence of sanction from the proper authority as prescribed under Section 151 of the Act? 3. Whether the reassessment proceedings initiated by issuing notice u/s 148 for AY 2016-17 are bad in law due to the absence of sanction from the proper authority as prescribed under Section 151 of the Act? Assessee's Contentions: For AY 2015-16, the assessee argued that the notice u/s 148 dated 30.06.2022 is barred by limitation, citing the Supreme Court's concession in Union of India vs. Rajiv Bansal that for AY 2015-16, notices issued on or after 01.04.2021 would be dropped as they fall outside the period prescribed under TOLA. The assessee also argued that the sanction for the notice was not obtained from the proper authority as per Section 151. For AY 2016-17, the assessee argued that the approval for the notice u/s 148 dated 30.06.2022 was accorded by an inappropriate authority (PCIT-15 instead of PCCIT or CCIT) as the notice was issued beyond three years, making the notice and subsequent proceedings invalid. The assessee relied on Union of India & Ors Vs. Rajeev Bansal and other case laws. Revenue's Contentions: The revenue relied on the impugned orders.
