What did the Tribunal hold?

The Tribunal condoned the delay of 27 days in filing the appeal, finding that the explanation for the delay did not indicate mala fides and that the Revenue had not gained anything by the delay. Regarding the substantive appeal, the Tribunal held that the CIT(A) was correct in following the ratio of the jurisdictional High Court in the case of Ojjus Medicare Pvt. Ltd. The Tribunal noted that the mere pendency of an SLP against the High Court's judgment has no consequence. Therefore, the grounds of appeal raised by the Revenue were considered devoid of merit and were rejected. The assessment order dated 31.03.2023 was held to be illegal by the CIT(A) by following the ratio of the jurisdictional High Court. No issue was expressly left undecided.

What were the facts?

The Revenue (Deputy Commissioner of Income Tax) is in appeal against the order of the Commissioner of Income Tax (Appeals)-27, New Delhi, dated 19.01.2026. The appeal challenges the CIT(A)'s decision which allowed the assessee's (Rakesh Sharma) appeal against the assessment order dated 31.03.2023 passed by the Assessing Officer (DCIT, Central Circle-28, New Delhi) under section 153C of the Income Tax Act, 1961, for Assessment Year 2011-12. The Revenue's appeal was filed with a delay of 27 days. The original return of income was filed on 23.03.2012. A search and seizure operation on 18.10.2019 led to the recovery of documents from the assessee's premises, prompting the issuance of a notice under section 153C. The AO made additions under sections 69A and 69C, including protective additions. The CIT(A) allowed the assessee's appeal.

What were the issues?

1. Whether the Tribunal has jurisdiction to entertain the appeal filed by the Revenue, considering the delay of 27 days in filing. 2. Whether the CIT(A) was justified in relying on the judgment of the Hon'ble High Court of Delhi in the case of PCIT, Central Circle-1, Delhi vs. Ojjus Medicare Pvt. Ltd. (ITA No. 52/2024) when the Revenue had filed a Special Leave Petition (SLP) against that decision. Assessee's Contention: The assessee's Authorized Representative referred to a chart in terms of the judgment of the Hon'ble High Court of Delhi in Ojjus Medicare Pvt. Ltd. (no specific arguments recorded beyond this reference). Revenue's Contention: The Revenue argued that the CIT(A) was not justified in relying on the judgment of the Hon'ble High Court of Delhi in PCIT, Central Circle-1, Delhi vs. Ojjus Medicare Pvt. Ltd. even though the Revenue had filed an SLP against that decision.

Which sections of the Income-tax Act were involved?

2.

Brief facts of the case are that the assessee filed original return of income on 23.03.2012 declaring income of Rs10,50,704/-. A search and seizure proceeding u/s 132 of the Act was carried out on the Alankit Group, Sh. Alok K Agarwal and some of the close associates and key employees of Sh. Alok K Agarwal on 18.10.2019. Incriminating seized evidences recovered during the course of search proceedings clearly establish that Sh. Alok Agarwal, had facilitated acquisition of shares of several shell entities for benefit of his own group as well as his known associates and clients. He has received and provided accommodation entries and also facilitated bogus short-term capital loss to set off long-term capital gains to various persons through several entities managed and controlled by him and his associates. Some incriminating documents were found from the premises in the name of the assessee; hence, case of the assessee was centralized to Central Circle-28, New Delhi. 3.

Against assessment order dated 31.03.2023 of ld. AO, the assessee filed appeal before Ld. CIT(A) which was allowed vide order dated 19.01.2026.

4.

Being aggrieved, the Revenue preferred application for condonation of delay of 27 days in filing appeal and appeal.

5.

In application for condonation of delay of 27 days, it is submitted that the delay was due to heavy workload in time barring scrutiny cases, appeal effect etc. The explanation for condonation of delay does not smack of mala fides as the revenue has not gained anything by not filing of appeal within period of limitation. Therefore, the delay of 27 days in filing appeal before the Tribunal is condoned.

6.

Ld. Departmental Representative submitted that Ld. CIT(A) was not justified in relying upon judgment of Hon’ble High Court of Delhi in case of PCIT, Central Circle-1, Delhi vs. Ojjus Medicare Pvt. Ltd. ITA No. 52/2024 even when Revenue has filed a SLP against decision.

7.

Ld. Authorized Representative for assessee referred to chart in terms of judgment of Hon’ble High Court of Delhi Ojjus Medicare pvt. Ltd. reads as under:

8.

From examination of record in light of aforesaid rival contention, it is crystal clear that Ld. CIT(A) vide order dated 19.01.2026, by following ratio of Jurisdictional High Court in Ojjus Medicare Pvt. Ltd. had held the impugned assessment order dated 31.03.2023 to be illegal. Mere pendency of SLP against the judgment of the Jurisdictional High Court is of no consequence. Therefore, the grounds of appeal being devoid of merit are rejected. The grounds of appeal of Revenue are rejected.
