DEPUTY COMMISSIONER OF INCOME TAX, INTERNATIONAL TAXATION, CIRCLE GURGAON, HARYANA vs. DEVINDER ARORA, HARYANA
In favour of the assessee: the Revenue's appeal was dismissed. From the AI summary of this appeal.
What did the Tribunal hold?
The Tribunal upheld the order of the CIT(A) and dismissed the Revenue's appeal. The Tribunal found no violation of Rule 46A of the Income Tax Rules, 1962. A perusal of the remand report showed that while the AO commented on documents related to time deposits, equity shares, and interest income, no comments were offered regarding the documents explaining the credits of Rs. 1,87,17,709/- in the assessee's HDFC bank account. Therefore, the CIT(A)'s observation that the AO made no adverse comments on this specific issue was factually correct. The Tribunal also noted that the assessee had provided bank statements for the HDFC NRE savings account, showing credits aggregating to Rs. 1,87,17,709/-. The CIT(A) had recorded that the source of these credits was predominantly salary, maturity proceeds of fixed deposits, and repayment of loans from family members. These findings by the CIT(A) were unrebutted. Consequently, the Tribunal held that the assessee had discharged its onus in proving the source of credits in its bank account and found no reason to interfere with the CIT(A)'s well-reasoned order.
What were the facts?
The Revenue is in appeal against the order of the CIT(A) dated 28.10.2025 for Assessment Year 2018-19. The Assessing Officer (AO) had made an addition of Rs. 1,87,17,709/- under Section 69A read with Section 115BBE of the Income Tax Act, 1961, on account of unexplained credits in the assessee's HDFC Bank account. The assessee did not respond to notices issued by the AO, including a notice under Section 148. The assessee subsequently filed additional evidence before the CIT(A), who sought a remand report from the AO. The CIT(A) deleted the addition, holding that the AO's remand report did not contain adverse comments on the explanation for the credits. The Revenue contends that the CIT(A) erred in this finding and that the AO's remand report did contain objections.
What were the issues?
1. Whether the CIT(A) erred in deleting the addition of Rs. 1,87,17,709/- made by the AO under Section 69A read with Section 115BBE of the Income Tax Act, 1961, on account of unexplained credits in the assessee's HDFC Bank account, by holding that the AO's remand report did not contain adverse comments. Assessee's contentions: The assessee, a non-resident, argued that notices from the AO were not served, hence the lack of response. Additional evidences, including bank statements, fixed deposit statements, and employment letters, were filed before the CIT(A) under Rule 46A. The assessee claimed the credits in the NRE account were from overseas salary remittances, maturity of fixed deposits, and repayment of loans from relatives. The assessee relied on the CIT(A)'s finding that the AO's remand report lacked adverse comments regarding these credits. Revenue's contentions: The Revenue argued that the CIT(A) erred in observing that the AO's remand report had no adverse comments. The Revenue pointed out that the AO's remand report, as reproduced in the CIT(A)'s order, did raise objections on the admission of additional evidence and on merits. The Revenue prayed for reversal of the CIT(A)'s findings and upholding the addition.
Which sections of the Income-tax Act were involved?
Section 69A,Section 115BBE,Section 148,Section 142(1),Section 144,Section 144C(iii)

Income Tax Appellate Tribunal, DELHI
Before: VIKAS AWASTHY & BRAJESH KUMAR SINGH
PER VIKAS AWASTHY, JUDICIAL MEMBER: This appeal by the Revenue is directed against the order of Commissioner of Income Tax (Appeals), Delhi-43 [in short ‘the CIT(A)’] dated 28.10.2025, for Assessment Year 2018- 19.
Shri Vikram Singh Sharma, representing the department submits that the Assessing Officer (AO) in the assessment order dated 19.05.2023 inter alia made addition of Rs.1,87,17,709/- u/s69A r.w.s. 115BBE of the Income Tax Act, 1961(hereinafter referred to as ‘the Act’) in respect of unexplained credits in HDFC Bank Account of the assessee. The ld. DR submits that no submissions were made by the assessee before the AO to explain source credits in the aforesaid bank account, in fact the assessee did not respond to any of the notices including notice u/s.148 of the Act issued by the AO. The assessee filed additional evidences before the 1
ITITA 74/DEL/2025 DEVINDER ARORA CIT(A). Remand report was sought by the CIT(A) from the AO on additional evidences. The AO furnished remand report on the additional evidences. The CIT(A) without considering the remand report deleted the addition of Rs. 1,87,17,709/-. Referring to findings of the CIT(A) in para 9.2.7 of the impugned order, the ld. DR submits that the CIT(A) has erred in recording that, ‘the AO in her remand report has not made any adverse comments.’ Whereas, in the remand report reproduced by the CIT(A) at page 32 to 35 of the impugned order, the AO has raised objections on admissions of additional evidences as well as on merits. The ld. DR thus prayed for reversing findings of the CIT(A) and upholding the addition.
Per contra, Ms. Ananya Kapoor, appearing on behalf of the assessee submits that the assessee is a non-resident. The notices issued by the AO were never served on the assessee, therefore, the assessee could neither respond the notice issued u/s.148 of the Act or the subsequent notices issued u/s.142(1) of the Act. The assessee had explained this fact before the CIT(A) and had filed additional evidences under Rule 46A of the Income Tax Rules, 1962 before the CIT(A). The additional evidences filed by the assessee inter alia includes HDFC Bank Statements, fixed interest statement, tax clearance certificate, employment letter, passport details, assessment order for AY 2019-20 etc. The CIT(A) after appreciating facts and examining the documents files by the assessee admitted additional evidences and forwarded the same to the AO for comments. The AO in remand report made comments in respect of documents furnished by the assessee to counter addition made in respect of:
(i) time deposit Rs.3,00,000/-; (ii) investments in equity shares Rs.3,13,189/-; & (iii) interest received from HDFC Bank Rs.9,67,158/-. No comments were offered by the AO in respect of credits of Rs.1,87,17,709/- in assessee’s HDFC bank account. Since, no comments or adverse comments were made by the AO in respect of the issue of credits in the bank account, the CIT(A) in para 9.2.7 of the impugned order recorded that the AO in remand report has not made any adverse comments.
3.1. On merits the ld. Counsel submitted that the assessee is working in Nigeria since long, hence, the assessee is a Non Resident Indian. The amounts credited in HDFC NRE Bank Account is from remittances made by the assessee from his overseas salary, maturity of fixed deposits, amounts received from relatives on repayment of loans. The entire credits that have been brought to tax u/s.69A of the Act by the AO are from the bank transfers and not cash deposits. He thus, prayed for confirming findings of the CIT(A) and dismissing Revenue’s appeal.
ITITA 74/DEL/2025 DEVINDER ARORA 4. Both sides heard, orders of the lower authorities examined, documents on which ld. Counsel for the assessee has placed reliance considered. The Department in appeal, has assailed findings of the CIT(A) in deleting addition of Rs.1,87,17,709/- on merits as well as alleging violation of Rule 46A(3).
Admittedly, in absence of participation by the assessee in assessment proceedings, the AO completed the assessment u/s.144 r.w.s. 144C(iii) of the Act, inter alia making addition of Rs.1,87,17,709/-u/s.69A of the Act in respect of credits in assessee’s HDFC Bank Account. The assessee filed additional evidences in First Appellate Proceedings before the CIT(A), the CIT(A) sought remand report which has been reproduced in the impugned order at pages 29 to 35. A perusal of the remand report reveals that the AO has made comments on the documents furnished by the assessee with respect to addition of time deposits Rs.3,00,000/-, investment in equity shares Rs.3,13,189/- and interest Rs.9,67,158/- but has not offered any comments in respect of documents furnished by the assessee to explain credits of Rs.1,87,17,709/-in his HDFC bank account. Thus, there is no violation of Rule 46A of the Income Tax rules, 1962 as alleged by the Department.
The assessee has furnished account statement of his HDFC Bank NRE saving account, wherein amounts aggregating to Rs.1,87,17,709/- were credited, at page 215 to 236 of the paper book. The First Appellate Authority after examining assessee’s bank account has recorded that the source of credits in assessee’s bank account is predominately form salary Rs.64,52,126/-, maturity proceeds of earlier fixed deposits Rs70,74,370/- and repayment of loans given to his family members in the same year Rs.33,60,000/-, apart from dividends, interest, etc. These findings of the CIT(A) are unrebutted. Thus, the assessee discharged its onus in proving source of credits in his HDFC Bank account.
We see no reason to interfere with the well-reasoned order of the First Appellate Authority. The grounds raised by the Department assailing findings of the CIT(A) are without merit, hence, dismissed. In the result, impugned order is upheld and appeal of the Revenue is dismissed.
