What did the Tribunal hold?

The Tribunal held that the CIT(A) annulled the assessment order for non-quoting of the DIN Number. The Parliament inserted section 292BA by the Finance Act, 2026, with retrospective effect from 01.10.2019, to clarify that no assessment shall be invalid on account of any mistake, defect, or omission in respect of non-quoting of the DIN Number. In view of this legislative amendment, the Tribunal was of the considered opinion that the order of the CIT(A) needed to be reversed. The matter was remitted back to the file of the CIT(A) for de novo disposal of the issues in appeal in accordance with law, after affording an opportunity of being heard to the respondent assessee. The Tribunal noted that the assessment order was quashed by the CIT(A) for non-quoting of DIN, and the insertion of section 292BA with retrospective effect from 01.10.2019 validates such orders. The Tribunal did not decide the merits of the addition made by the AO.

What were the facts?

The Revenue is in appeal against the order of the CIT(A) dated 26.12.2025 for Assessment Year 2014-15. The assessee, Bhagyashree Jain, had filed her return of income on 31.07.2014. The Assessing Officer (AO) completed the assessment under section 143(3) read with section 147 on 24.10.2019, making an addition of Rs. 2,80,73,000/-. The assessee had received this sum from a partnership firm on revaluation of closing stock, which was not offered to tax. The AO had issued a notice under section 148 on 01.10.2018. The assessee responded by treating her original return as the return for the section 148 notice. The AO then completed the assessment at a total income of Rs. 4,98,90,710/-. The CIT(A) allowed the assessee's appeal, quashing the assessment order for not containing a Document Identification Number (DIN).

What were the issues?

1. Whether, on the facts and in the circumstances of the case and in law, the Ld. CIT(A) was justified in quashing the impugned order passed under section 143(3) read with section 147 dated 24.10.2019 on account of it being issued without a DIN, without appreciating that a detailed process was followed while uploading the order in Income Tax Business Application (ITBA)? (Question of law and fact, turning on the validity of assessment orders without DIN). 2. Whether the Ld. CIT(A) was justified in quashing the order on account of it being issued without a DIN, without appreciating that the DIN was generated on RAM on 24.10.2019 itself, though intimated to the assessee later? (Question of law and fact, turning on the timing and intimation of DIN). 3. Whether the Ld. CIT(A) was justified in quashing the order without considering the Supreme Court's decision in Commissioner of Income Tax vs. Brandix Mauritius Holdings Ltd. and Sutherland Global Services Inc., where interim stays were granted on similar grounds of non-quoting of DIN? 4. Whether the Ld. CIT(A) was justified in quashing the order without appreciating that the intent of CBDT Circular No. 19/2019 was to maintain an audit trail and that the circular is directory rather than mandatory? Revenue's Contentions: The Revenue argued that the insertion of section 292BA with retrospective effect from 01.10.2019 by the Finance Act, 2026, validates assessments where DIN was generated but had technical defects, provided the order is referenced by its number. Therefore, the assessment order should not be invalid due to non-quoting of DIN. They relied on the Finance Bill, 2026, proposing section 292BA. The Revenue also referred to Supreme Court orders in Brandix Mauritius Holdings Ltd. and Sutherland Global Services Inc. and CBDT Circular No. 19 of 2019, arguing the circular is directory. Assessee's Contentions: No arguments were recorded for the assessee as no one appeared on their behalf.
