What did the Tribunal hold?

The Tribunal held that the learned CIT(E) rejected the assessee's application for approval under Section 80G primarily on the ground of non-compliance with the terms of the notice issued, which prevented the recording of the requisite satisfaction regarding the objects and genuineness of the trust's activities. Observing that the impugned order was passed ex parte, the Tribunal was of the considered opinion that the assessee deserved one more effective opportunity to present all relevant material before the CIT(E). The Tribunal emphasized that the principles of natural justice mandate affording an adequate and meaningful opportunity to the applicant to explain its case and furnish necessary documents before rejecting an approval under Section 80G. Accordingly, in the interest of substantial justice, the Tribunal set aside the impugned orders and restored both matters to the file of the CIT(E) for fresh adjudication in accordance with law, after providing an adequate opportunity of hearing. The assessee was directed to cooperate fully and furnish all required information without seeking unnecessary adjournments. The appeal was allowed for statistical purposes.

What were the facts?

The assessee, Sulochana Foundation, filed an appeal against the order passed by the learned Commissioner of Income Tax (Exemption), Mumbai. The CIT(E) had rejected the assessee's application for approval under Section 80G of the Income-tax Act, 1961. The rejection was primarily based on the assessee's non-compliance with the terms of a notice issued during the proceedings. The assessee contended that the impugned order was passed ex parte, without providing an effective and reasonable opportunity of hearing. The revenue, through the Senior Departmental Representative, left the issue to the discretion of the Tribunal. The appeal was filed against the order of the CIT(E).

What were the issues?

1. Whether the rejection of the application for approval under Section 80G of the Income-tax Act, 1961, by the learned CIT(E) was justified on the grounds of non-compliance with the notice terms, thereby violating the principles of natural justice by passing an ex parte order? Assessee's Contentions: The assessee argued that the impugned orders were passed ex parte, without granting an effective and reasonable opportunity of hearing. It was prayed that the matter be restored to the file of the learned CIT(E) for fresh adjudication after providing adequate opportunity. The assessee relied on the principles of natural justice. Revenue's Contentions: The learned Departmental Representative fairly left the issue to the discretion of the Bench.

It was, therefore, prayed that the matter may be restored to the file of the learned CIT(E) for fresh adjudication after providing adequate opportunity to the assessee. We have considered the rival submissions and perused the material available on record. From the impugned orders, it is evident that the learned CIT(E) has rejected the applications mainly on the ground that the assessee had not complied with all the terms of the notice issued and, therefore, the requisite satisfaction regarding the objects of the trust and the genuineness of its activities could not be recorded. Since the impugned order has been passed ex parte, we are of the considered opinion that the assessee deserves one more effective opportunity to place all the relevant material before the learned CIT(E).
