the addition of Rs 18,22,300/- made by the Assessing Officer under section 50C of the Income-tax Act. 1961 treating the same as deemed capital gains
That the learned CIT(A) erred in law and on facts in upholding the adoption of the valuation determined by the Departmental Valuation Officer (DVO) at Rs 24,32,300/-without appreciating that the actual sale consideration received by the assessee was genuine, bona fide and supported by registered sale deeds
That the learned CIT(A) failed to appreciate without considering the approach, condition & location of the property and uphold the Assessment order which is totally based upon surmises, hypothetically and ignoring of the facts:
That the learned CIT(A) erred in law in holding that the DVO's valuation is binding, without appreciating that even the DVO valuation must be reasonable, cogent and based on comparable instances which was not demonstrated in the present case
That the learned CIT(A) erred in confirming rejection of the cost of acquisition merely on the ground of non-filing of documentary evidence without granting adequate opportunity and without appreciating the assessee's explanation regarding old properties and practical difficulty in producing records.
6 That the learned CIT(A) believed on the assessment order which suffers from mistake by blindly adopting DVO report That the learned CIT(A) failed to appreciate that the assessment as well as the appellate order suffer from violation of principles of natural Justice as the assessee was not granted effective opportunity to rebut the valuation report and consequential proposed addition. That the learned CTT(A) erred in law and on facts in dismissing the appeal by merely reiterating the findings of the Assessing Officer without dealing with the submissions made by the assessee.
That the learned CIT(A) erred in law and as well as on facts that it was held by various Hon'ble High Court that DVO's report is only an information and not the material.
I.T.A. No. 53/Lkw/2026 Assessment Year:2017-18 3
8 That the learned CIT(A) erred in law in confirming the addition despite the fact that no real income accrued or arose to the assessee and the addition is purely on the basis of notional and hypothetical income.”

In view of the foregoing discussion, and in the facts and circumstances of the case, the impugned appellate order of learned CIT(A) is set-aside and the issues in dispute in the present appeal are restored back to the file of the Assessing Officer with the direction to pass denovo assessment order in accordance with law after providing reasonable opportunity to the assessee.
