What did the Tribunal hold?

During a survey, unaccounted sales of Rs. 2,83,71,444/- were discovered, leading to an addition of Rs. 42,47,210/-. The assessee's appeal was previously remanded by the ITAT to the CIT(A) for de novo adjudication.

What were the issues?

Whether the CIT(A) failed to provide a proper opportunity of being heard, violating principles of natural justice, and whether the addition on account of unexplained sales was justified.

Income Tax Appellate Tribunal, RAIPUR BENCH, RAIPUR

Before: SHRI PARTHA SARATHI CHAUDHURY, JM & SHRI AVDHESH KUMAR MISHRA, AM

For Appellant: Shri Sunil Kumar Agrawal, CA
Hearing: 08/04/2026

Per Avdhesh Kumar Mishra, AM: This appeal for Assessment Year (‘AY’) 2019-20 filed by the assessee is directed against the order dated 25.11.2025 of the Commissioner of Income Tax (Appeals), Raipur-3, passed under section 250 of the Income Tax Act, 1961 (‘Act’).

2.

Vide 3 grounds of appeal, the assessee has raised following two issues: (i) Proper opportunity of being heard was not provided by the Ld. CIT(A). The Ld. CIT(A) had provided last opportunity of being heard on 21.11.2025 and disposed of the case on 25.11.2025. 1 (ii) Addition of Rs.42,47,210/- on merit.

3.

The relevant facts giving rise to this appeal are that the business premises of assessee was surveyed under section 133A of the Act on 19.02.2019. The assessee filed Income Tax Return (ITR) of the relevant year on 26.03.2020 declaring income of Rs.78,25,160/-. Being a survey case, the case was picked up for scrutiny. During the course of survey operation at the business premises of the assessee, certain incriminating materials were impounded. Based on the incriminating material, it was noticed that the assessee had not disclosed entire sales in its regular books of account. The sale data of the assessee compared with the monthly POS entries revealed that the sale as POS was Rs.8,09,43,147/- as against the sale of Rs.05,25,71,703/- recorded in regular books of accounts. The difference of Rs.2,83,71,444/-; i.e. the difference between sale as per the POS machine and sale as per the books of account, was treated as unexplained unaccounted sale of the assessee. During the course of survey operations, one of the partners of assessee surrendered the said income and admitted the unaccounted sale of Rs.2,83,71,444/- of the assessee. The Ld. Assessing Officer (‘AO’) applied average Gross Profit @14.97% on the unaccounted sale of Rs.2,83,71,444/-, which resulted addition of Rs.42,47,210/- in the hands of the assessee. The consequential scrutiny assessment, for the first time, was completed vide order dated 13.09.2021. Aggrieved with the assessment order dated 13.09.2021, the assessee filed appeal before the Ld. CIT(A), who dismissed the appeal. The assessee agitated by the said appellate order and filed appeal before the Tribunal, who remanded back the matter to the file of the Ld. CIT(A) vide its order dated 20.05.2025 in ITA 243/RPR/2025 as under:

“10. We have considered the rival submission and perused the material available on record. Admittedly, the matter has been decided by Ld. CIT(A) on ex-parte basis, wherein the assessee was unable to represent its case and had sought further time to represent. Under such facts and circumstances, as we have held in various cases, the matter needs to be restore back to the file of Ld. CIT(A) with the direction to the assessee to act vigilantly and mark it’s presence during the appellate proceedings, to which Ld. AR on behalf of the assessee has stated at bar that necessary appearance shall be made before the Ld. CIT(A) and requisite details shall be furnished without fail.

11.

Considering the totality of facts and circumstances of the present case, we find it appropriate to set aside the matter to the file of Ld. CIT(A) for denovo adjudication. Our aforesaid view is duly fortified and in conformity with our earlier decision in the case of Brajesh Singh Bhadoria Vs. Dy./ Asstt. Commissioner of Income Tax, Central Circle-2, in IT(SS) No. 1 to 6, 8 & 9/RPR/2025 dated 20.03.2025, wherein it has been decided to restore the matter back to the file of Ld. CIT(A), for the sake of clarity the relevant observations in the case of Brajesh Singh Bhadoria (supra), are extracted hereunder: …………………… ……………………..

12.

In view of aforesaid facts and circumstances, respectfully following the aforesaid decision in the case of Brajesh Singh Bhadoria (supra), as fairly conceded by both the parties herein, the matter is restored back to the file of Ld. CIT(A) for denovo adjudication, within a period of 3 months from the receipt of this order.

13.

Needless to say, the assessee shall be afforded with reasonable opportunity of being heard in the set aside appellate proceedings. The assessee is also directed to cooperate and assist proactively in the set aside proceedings, failing which the Ld. CIT (A) would be at liberty to decide the case in accordance with the mandate of law.”

4.

The Tribunal, vide its order dated 20.05.2025 in the case of assessee in ITA 243/RPR/2025, directed the Ld. CIT(A) to dispose of the remitted appeal within three months. Thus, the Ld. CIT(A), in remitted appellate proceedings, was having limited time period to dispose of the said appeal. In pursuance of the Tribunal order dated 20.05.2025 in the case of assessee in ITA 243/RPR/2025, the Ld. CIT(A) provided three opportunities of being heard to the assessee on (i) on 26.09.2025, (ii) 17.11.2025 and; (iii) 25.11.2025. However, the assessee did not respond to the same and sought adjournment one after another on one reasoning and another. The relevant finding of the Ld. CIT(A) in para No.2 of the impugned order reads as under:

“2. The appeal was fixed for hearing on 26.09.2025, 17.11.2025 & 25.11.2025. However, the assessee firm had filed an adjournment request through ITBA portal on 08.10.2025, which is as under:-

“In this case, the assessee-firm has received a notice from your Honor s office fixing the response dt. 26-9-25. It is humble request to grant adjournment of 20 days as it is audit period and also necessary documents and papers can be arranged for proper compliance and preparation of the case. So it is kindly requested to you Honor to grant adjournment of few days as per your convenience.

The adjournment request of the assessee has been considered and further hearing was fixed on 17.11.2025 vide hearing notice dt. 11.11.2025. The assesse has failed to submit any reply or adjournment in response to the aforesaid notice. Again hearing was fixed on 25.11.2025 vide hearing notice dt.21.11.2025, the assessee has again failed to submit any reply or adjournment in response to the aforesaid notice.

Thereafter the assessee firm never filed any reply or adjournment in response to hearing notices dt.11.11.2025 and 21.11.2025. The assessee firm is completely failed to submit its reply in favour of its appeal after lapse of 03 opportunities and also until the passing of this order. Therefore, it is held that the assessee firm has no interest in this appeal.

This appeal had already been decided by the CIT(A) vide its order u/s 250 of the Act dt. 18.02.2025 and the assessee had challenged the order of the CIT(A) and filed an appeal before the Hon’ble ITAT, Raipur Bench. The Hon’ble ITAT, Raipur Bench set aside the CIT(A)’s order and restore the case in the file of the CIT(A) for de novo adjudication and has directed to pass the order vide its order in ITA No.243./RPR/2025 dt. 20.05.2025. Since this order is received in this office on 26.08.2025 from O/o PCIT(Central), Bhopal vide its forwarding dt. 18.08.2025. Hence, considering the direction of the Hon’ble ITAT, Raipur bench further adjournment can’t be granted the order is being passed on the basis of material available on record.”

5.

On merit, the Ld. CIT (A) has decided the issue as under:

6.

This appeal before the Tribunal is for the second time.

7.

Shri Sunil Kumar Agrawal, Ld. Authorized Representative of the assessee submitted that the Ld. CIT(A) had not provided proper opportunity of being heard to the assessee and thus, he had not followed the principles of natural justice. He prayed for remanding matter back to the file of the Ld. CIT(A) for adjudication.

8.

The Ld. Sr. DR was not present when the matter was called for hearing. However, the matter was taken as heard considering the submissions of the Ld. AR of the assessee and on a careful perusal of the material available on the record.

9.

We have heard the Ld. AR at length and have perused the material available on the record. This is a second round of litigation before us. In first round, the matter was remitted back to the file of the Ld. CIT(A) for fresh adjudication; however, the assessee did not pursue the appeal properly within the reasonable time frame available with the Ld. CIT(A). It is evident from the impugned order that the Ld. CIT(A) has provided three opportunities of being heard as mentioned above in para 4. Since the Ld. CIT(A) was having only three months’ time to dispose off the appeal in view of the direction of the Tribunal order dated 20.05.2025 in the case of assessee in ITA 243/RPR/2025; therefore, he cannot adjourn the case beyond three months’ time as desired by the assessee. The facts on the record clearly demonstrate that the Ld. CIT(A) has provided reasonable opportunity of being heard to the assessee. Non-compliance on the part of the appellant assessee cannot be taken as an excuse for remanding matter again for the second time. The non-pursuance of its appeal by the assessee in remitted appellate proceedings before the Ld. CIT(A) clearly shows that the assessee is not interested in pursuing its appeal before the Ld. CIT(A) within the specified time of three months as per the Tribunal order dated 20.05.2025 in the case of assessee in ITA 243/RPR/2025. In view of the facts, we do not find any violation of principle of natural justice on the part of the ld. CIT(A). Thus, we dismiss Ground No. 1 raised by the assessee.

10.

We have heard the Ld. AR at length and have perused the material available on the record. This is a second round of litigation before us. After thoughtful consideration, we are of the view that the remitting matter back again to the file of Ld. CIT(A) for second time due to consistent non-compliance before the Ld. CIT(A) will set a wrong precedent particularly when the finding of the Ld. CIT(A) on merit of the addition is well reasoned and requires no interference from us. We, therefore, keeping in view the entire facts of the case and finding of the Ld. CIT(A) in impugned order decline to interfere with the impugned order. The appeal filed by the assessee is therefore, dismissed.

11.

In the result, the appeal of the assessee stands dismissed
