What were the issues?

Whether the delay in filing the appeal should be condoned due to a bonafide mistake, and whether the matter requires a fresh assessment due to ex-parte orders by lower authorities.

hence, the notices/order on the portal could not be seen. It is further submitted that on receipt of the demand notice dated 02.02.2026 from the Income-tax Department, he downloaded the ld. CIT (A)’s order on the same date and on the same date, he handed over the appellate order to the assessee. Accordingly, ld. AR of the assessee submitted that the delay caused due to the reason beyond the control of the assessee. He further submitted that it is settled position of law that where the delay was bonafide and there is sufficient cause for delay in filing appeal, the delay must be condoned by the appellate authority when it is necessary for rendering the substantial justice to the assessee. Accordingly, he pleaded to condone the delay. 3. On the other hand, ld. DR of the Revenue objected to the submissions of the ld. AR of the assessee stating that there is abnormal delay in filing the appeal. 4. Heard both the counsels on the issue of condonation of delay. In my considered opinion, there was a reasonable cause for the delay in filing the appeal. Therefore, I condone the delay in filing the appeal before the Tribunal. 5. At the time of hearing, it was observed that that there is no compliance before the ld. CIT (A) who decided the issue against the assessee by observing that assessee has not pursued the appeal despite being granted several opportunities and the details are given in the first appellate order, accordingly, dismissed the appeal. It is observed that ld. CIT (A) has not decided the issue on merit and affirmed the order of the Assessing Officer who has also passed the order ex- parte. Ld. DR of the Revenue relied on the orders of the lower authorities.

6.

Considered the rival submissions and material placed on record. Upon careful consideration, I am of the considered view that in the interest of justice, the matter requires denovo assessment. Therefore, I remit back the issues to the file of the Assessing Officer with the directions to decide the same afresh, after giving adequate opportunity of being heard to the assessee, for which Ld. DR has no objection. Assessee is directed to fully cooperate with the AO during the proceedings. I hold and direct accordingly. 7. In the result, the appeal filed by the assessee is allowed for statistical purposes. Order pronounced in the open court on this 16th day of June, 2026
