What did the Tribunal hold?

The Tribunal held that the reopening of assessment was invalid as it was based on incorrect facts. The assessee had actually earned short-term capital gain, which was offered to tax, and no exemption under Section 10(38) was claimed for the sale of BMS Industries Ltd. shares.

What were the facts?

The assessee's return of income for AY 2012-13 was processed, and the assessment was later reopened under Section 147/148. What were the issues?

The primary issue was the validity of the reopening of assessment under Section 147/148, specifically whether it was based on correct facts and information.

Which sections of the Income-tax Act were involved?

Section 147,Section 148,Section 10(38)
