What did the Tribunal hold?

The Tribunal held that the AO was not justified in invoking Section 68 as the cash deposits were recorded as cash sales in the assessee's regular books of account, which were not rejected. The addition was based on suspicion without cogent material to disprove the assessee's explanation.

What were the facts?

The assessee company reported abnormal cash deposits during the demonetisation period, attributed to increased sales of a new product. The Assessing Officer (AO) treated these deposits as unexplained cash credits, disallowing the claim due to the assessee's failure to produce books of account and supporting documents.

What were the issues?

Whether cash deposits recorded as sales in accepted books of account can be treated as unexplained cash credits under Section 68 without rejecting the books or disproving the explanation with cogent evidence.
