This appeal has been filed by the assessee against the order dated 30.09.2025 passed by the learned Commissioner of Income Tax (Exemption) [CIT (Exemption)].
Brief facts of the case are that the assessee had filed an application under Section 12A(1)(ac)(ii) of the Income Tax Act, 1961. The application filed by the assessee was rejected on the ground that the same was filed beyond the prescribed
ITA No. 187/RJT/2026 Shree Bhutadadada Mochi Samaj Cheritable Trust Jasdan period of six months prior to expiry of the provisional registration/commencement period of activities.
Aggrieved by the order of CIT (Exemption) assessee is in appeal before this tribunal.
At the time of hearing we notice that there was also a delay of 77 days in filing the present appeal before the Tribunal. In this regard, the assessee filed an application seeking condonation of delay. After considering the reasons stated therein, we condone the delay and proceed to adjudicate the appeal on merits.
On the date of hearing, none appeared on behalf of the assessee despite service of notice. Therefore, we proceeded to hear the matter with the assistance of the learned Departmental Representative.

We have heard the submissions and examined the material available on record. Considering the facts and circumstances of the case, and in the interest of justice, we deem it proper to restore the matter to the file of the learned CIT (Exemption) with a direction to examine the issue afresh in accordance with law and pass an appropriate order after providing reasonable opportunity of hearing to the assessee.
