AI SummaryRemanded

What did the Tribunal hold?

The Tribunal condoned the delay in filing the appeal before the CIT(A) and noted that the AO and CIT(A) decided the case ex-parte. The Tribunal found that the addition of the entire sale consideration was incorrect as the assessee's share was only 1/14th.

What were the facts?

The assessee did not file a return of income. The Assessing Officer (AO) reopened the case and added the entire sale consideration of an immovable property as short-term capital gain, despite the assessee's share being only 1/14th. The CIT(A) dismissed the assessee's appeal due to a delay and non-compliance.

What were the issues?

Whether the entire sale consideration of a property can be added as capital gain when the assessee is only a co-owner with a fractional share. Whether the delay in filing an appeal before the CIT(A) should be condoned on genuine grounds.

Which sections of the Income-tax Act were involved?

Section 147,Section 148,Section 148A

For Appellant: Shri P.K. Roy, AR
For Respondent: Shri Praveen Das, DR
Hearing: 29.06.2026Pronounced: 30.06.2026

Per Rajesh Kumar, AM:

This is an appeal preferred by the assessee against the order of the National Faceless Appeal Centre, Delhi (hereinafter referred to as the “Ld. CIT(A)”] dated 30.01.2026 for the AY 2016-17.

2.

The assessee has challenged the order of ld. CIT (A) confirming the assessment order, wherein the addition of ₹2,87,44,375/- was made by the ld. AO by adding the entire sale consideration which even did not belong to him and relate to other co-owners.

4.

Similarly, before the le CIT (A), the assessee did not respond to various notices issued and the case was dismissed in limine by the ld. CIT (A) by not condoning the delay of 115 days in filing the appeal.

5.

After hearing the rival contentions and perusing the materials available on record, we find that the appeal before the ld. CIT (A) is late by 115 days, which were explained by the assessee to be on account of genuine and bonafide reasons and accordingly, we are inclined to condone the same. We note that the ld. AO as well as the ld. CIT (A) has decided the issue ex-parte. The assessee during the course of hearing has furnished before us the copy of conveyance deed evidencing the fact that the assessee’s share in the said property was only 1/14th and therefore, even the addition made by the ld. AO treating the entire sale consideration as short-term capita

6.

In the result, the appeal of the assessee is partly allowed for statistical purposes.

Order pronounced on 30.06.2026.
