and secondly that the legal issues raised before Ld. CIT(A) has been adjudicated.
At the outset Ld. Counsel for the assesse requested for restoring the matter to the file of Ld. CIT(A) for necessary adjudication of the legal issues raised in Form No. 35 challenging the validity of the assessment order framed u/s 144 of the Act for A.Y. 2019-20.
On the other hand Ld. Departmental Representative (DR) supported the order of Ld. CIT(A).
We have heard rival contentions and perused the record placed before us. On going through the impugned order we note that the assessee has raised legal ground challenging the validity of assessment order. However Ld. CIT(A) has not adjudicated these legal issues. We therefore considering the prayer made by the Ld. Counsel for the assessee deem it appropriate to restore all the issues raised in the instant appeal including the legal issues challenging the validity of assessment order, to the file of Ld. CIT(A) for necessary adjudication in accordance with law. Needless to mention that proper opportunity of hearing shall be given to the assessee. Assessee is also directed to remain vigilant and not to take unnecessary adjournment unless otherwise required for reasonable cause. Effective grounds of appeal raised by the assessee are allowed for statistical purposes.
In the result, appeal of the assessee is allowed for statistical purposes.
