Income Tax Appellate Tribunal, ‘H(SMC

For Respondent: Shri Pravin Salunkhe
Hearing: 11/03/2026Pronounced: 02/06/2026

आदेश / O R D E R PER AMIT SHUKLA (J.M): The present appeal has been filed by the assessee against the order dated 29.09.2025 passed by the learned Commissioner of Income Tax (Appeals) for Assessment Year 2012-13.

2 ITA No.625/Mum/2026 Dharmchand Padamchand Jain 2. The assessee has raised various grounds challenging the validity of reassessment proceedings under section 147 and also the addition of Rs.19,18,348/- made under section 68 on account of sale proceeds of shares of Blueprint Securities Ltd. However, at the outset, the learned counsel submitted that both the assessment order as well as the impugned appellate order have been passed ex parte and, therefore, the matter may be restored to the file of the Assessing Officer for fresh adjudication.

3.

In support of the said plea, our attention was drawn to the affidavit filed by the assessee explaining the circumstances which prevented him from pursuing the proceedings before the lower authorities. It has been stated therein that during the relevant period the assessee’s wife was diagnosed with cancer and was undergoing continuous medical treatment and follow up procedures. Owing to her serious medical condition, the assessee’s entire attention remained focused on her treatment and care, resulting in his inability to properly attend to his tax matters. It has further been stated that immediately after the situation stabilized, he contacted his tax consultant and initiated the process of pursuing the present appeal.

4.

We have considered the rival submissions and perused the material placed before us. From the records, it is evident that

3 ITA No.625/Mum/2026 Dharmchand Padamchand Jain the assessment itself has been framed ex parte under section 144 read with section 147 and the learned CIT(A) has also dismissed the appeal ex parte. Thus, effectively, the assessee has not been afforded an effective opportunity to place his case either before the Assessing Officer or before the first appellate authority.

5.

Considering the explanation furnished by the assessee in the affidavit and having regard to the peculiar facts and circumstances of the case, we are satisfied that there existed a reasonable and bona fide cause for the assessee’s non appearance before the authorities below. The explanation appears to be genuine and deserves acceptance. In our considered opinion, the ends of justice would be met if one more opportunity is granted to the assessee to substantiate his case before the Assessing Officer.

6.

Accordingly, without expressing any opinion on the merits of the issues involved, we set aside the impugned order of the learned CIT(A) as well as the assessment order and restore the entire matter to the file of the Assessing Officer for adjudication afresh in accordance with law after providing adequate opportunity of hearing to the assessee. The assessee is also directed to fully cooperate in the assessment proceedings and furnish all necessary details and evidences as may be called for by the Assessing Officer.

4 ITA No.625/Mum/2026 Dharmchand Padamchand Jain 7. In the result, the appeal of the assessee is allowed for statistical purposes.
