MEERAN ABDUL ZAHID,BELLARY, KARNATAKA vs. ASSISTANT COMMISSIONER OF INCOME TAX, ACIT, CENTRAL CIRCLE, BALLARI, KARNATAKA
In favour of the assessee: the assessee's appeal was allowed. From the AI summary of this appeal.
What did the Tribunal hold?
The Tribunal held that the penalty notices were invalid and void ab initio because the Assessing Officer failed to specify whether the penalty was for concealment of income or furnishing inaccurate particulars of income. This failure vitiated the penalty proceedings.
What were the facts?
The assessee's appeals concerned penalty levied under Section 271(1)(c) of the Income Tax Act for multiple assessment years. The primary contention was that the penalty notices issued under Section 274 were invalid as they did not specify the exact limb of Section 271(1)(c) under which the penalty was initiated.
What were the issues?
Whether penalty proceedings under Section 271(1)(c) are valid when the notice issued under Section 274 does not specify the specific limb of the section under which the penalty is being levied.
Which sections of the Income-tax Act were involved?

MANISH BORAD, ACCOUNTANT MEMBER : The captioned appeals at the instance of assessee pertaining to A.Yrs. 2005-06, 2007-08, 2008-09 and 2009-10 are directed against the separate orders dated 29.07.2025 CIT(A)-2, Panaji arising out of respective Assessment Orders passed u/s.143(3) r.w.s.153A of the Income Tax Act, 1961 (in short ‘the Act’).
The common issue raised in all these appeals is against the levy of penalty u/s.271(1)(c) of the Act.
At the outset, ld. Counsel for the assessee referring to common legal issue raised in Ground No.3 submitted that the notice issued u/s.274 of the Act does not specify the limb of section 271(1)(c) of the Act under which the penalty has been initiated, i.e. whether for the concealment of particulars of income or furnishing of inaccurate particulars of income. Reference made to the show cause notices which are same for all the impugned assessment years and he stated that ld. Assessing Officer has not striked off the limb not applicable to the assessee. Further reference made to the plethora of decisions consistently holding that where specific charge has not been levelled against the assessee by the Assessing Officer in the show cause notice u/s.274 of the Act, then in such situation, the penalty proceedings have been held to be bad in law and void ab-initio. In support, Ld. Counsel for the assesee relied on the following case laws :

On the other hand, ld. DR supported the orders of ld.CIT(A).
We have heard the rival contentions and perused the record placed before us. The assessee has raised common legal issue challenging the levy of penalty u/s.271(1)(c) of the Act for the A.Yrs. 2005-06, 2007-08, 2008-09 and 2009-10 alleging that notice issued u/s.274 of the Act is invalid and bad in law. Notice u/s.274 of the Act issued by the Assessing Officer for A.Y. 2005-06 is scanned below :
//this space is intentionally left blank //
It is admitted by both the sides that similar type of show cause notices have been issued for A.Yrs. 2007-08, 2008-09 and 2009-10. On perusal of the above show cause notice, it is evident that ld. Assessing Officer has mentioned both the charges that the assessee has concealed the particulars of income and/or furnished inaccurate particulars of income. We note that ld. Assessing Officer has not levied a specific charge as to whether the assessee has concealed the particulars of income or has furnished inaccurate particulars of income which is the requirement of law. Ld. Assessing Officer was required to strike off the charge which is not applicable to the assessee and in absence of such exercise it has been consistently held by Hon’ble Courts and various Coordinate Benches that such penalty proceedings are vitiated and bad in law. We take note of the decision of Coordinate Bench, Panaji in the case of ACIT Vs. M/s. Goa Dourado Promotions Pvt. Ltd. – ITA No.276/PAN/2017 order dated 01.01.2019 and the relevant finding of Tribunal reads as under :
“10. We have heard both the counsel and perused the records. We find that the addition in this case has two components: Income returned by the assessee – Rs.3,61,96,711/- Addition made by the A.O. - Rs. 70,20,340 ------------------------------- - Rs.4,32,17,051/- ------------------------------- As regards the levy of penalty on the returned income of Rs.3,61,96,711/- is concerned, the same cannot be sustained as the penalty for concealment cannot be levied if the income is shown in the return of income. If anything was found on search or stated at the time of search has also not been specified by the A.O. In this regard, we draw support from the of Hon'ble Delhi High Court decision in the case of CIT vs. SAS Pharmaceuticals [2011] 335 ITR 259 (Del). The Hon’ble High Court has expounded that penalty u/s. 271(1)(c) can only be levied if in the course of proceedings, the A.O. is satisfied that there is an concealment or furnishing of inaccurate particulars. The words ‘'in the course of any proceedings under this Act mean the assessment proceedings'. However, the question ‘whether there is concealment or inaccurate particulars’ has to be determined with reference to the returned income. Accordingly, in the background of the aforesaid discussion and precedent, the penalty levied with reference to income retuned is not sustainable.
As regards the penalty on addition of Rs.70,20,340/- is concerned, we find that the entire addition made by the A.O. in this case finally stood deleted by the ld. CIT(A) and confirmed by the ITAT (in ITA No. 28/PAN/2017 vide order dated 12.04.2018). In this view of the matter, the penalty doesn't survive inasmuch as the addition with reference to which the penalty has been levied has been deleted. 12. We further find that in this case, the charge on which penalty has been levied has not been specified in the assessment order, as to whether the penalty has been levied for concealment of income or furnishing of inaccurate particulars of income with regard to the addition made by the A.O. This is followed by a notice for the levy of penalty u/s.271(1)(c) in which the specific limb identifying the charge has not been identified. In such scenario, the learned CIT-A has relied upon several case laws from the Hon'ble jurisdictional High Court and the Hon’ble Apex Court that penalty levied without specification of charge is not sustainable. In this regard, reference has been made to following case laws: • CIT vs. M/s. SSA’s Emerald Meadows (2015) 380 ITA (SC) • CIT vs. Manjunatha Cotton and Ginning Factory & Ors. (TS-936- HC-2012 (Kar)) • CIT vs. Shri Samson Perinchery (IT Appeals Nos. 953/1097/1154/1226 of 2014 vide order dated 05.01.2017)
In view of the above said case laws due to absence of satisfaction and identification of the specific charge for levy of penalty, the penalty in this case deserves to be deleted on this account also. In the background of aforesaid discussion and precedent, we uphold the deletion of penalty in this case.”
We further find that similar view has also been taken by Hon’ble Bombay High Court in the Full Bench judgment in the case of Mohd. Farhan A. Shaikh Vs. DCIT reported in (2021) 434 ITR 1. Respectfully following the same parity of reasoning, we find that in absence of specific charge levelled against the assessee ld. Assessing Officer failed to assume proper jurisdiction for carrying out the penalty proceedings u/s.271(1)(c) of the Act and therefore the same are held to be invalid void ab initio. Findings of ld.CIT(A) for all the assessment years under appeal are reversed and the impugned penalty u/s.271(1)(c) of the Act levied is deleted. Common legal issue raised by the assessee for A.Yrs. 2005-06, 2007-08, 2008-09 and 2009-10 are allowed.
Since the assessee succeeds on the legal issue commonly raised in the assessment years under appeal, dealing with remaining grounds on merit would be merely academic in nature and are dismissed as Infructuous.
In the result, all the appeals of the assessee are allowed.
