The assessee filed appeal before the ld.CIT(A) who dismissed the appeal in limine on the ground that despite given sufficient opportunity of hearing the assessee did not make any compliance and repeatedly sough adjournments. Moreover, no supporting evidence and explanations were furnished in support of the grounds of appeal.
When the case was called out by the Bench, none attended the proceedings. The ld.DR relied on the orders of authorities below.
We observe that the ld.CIT(A) dismissed the appeal in limine and did not adjudicate the issues raised in the grounds of appeal qua the materials available on record. Such dismissal without deciding the appeal on merits is contrary to the principles of natural justice. Under section 250(4) of the Act, the CIT(A) is empowered and duty bound to make such further enquiry as he thinks fit or direct the AO to make further enquiry. The powers conferred on the appellate authority u/s 250(4) of the Act, being quasi judicial powers, it is incumbent on him to exercise the same if the facts circumstances justify. However, in this case, it is equally true the assessee also did not make proper compliance.
P a g e | 6 ITA No. 1584/Mum/2026 A.Y. 2023-24 Baijinath Ram Khilawan Yadav 6.1 Considering the entirety of the facts and the circumstances of the case, we are of the view that the assessee should be a given one more opportunity of hearing following the principles of natural justice and the matter should be verified and revisited at the level of ld.CIT(A). Accordingly, the entire matter is remanded back to the file of the appellate authority for de novo adjudication by him after affording sufficient opportunity of being heard to the assessee. In case of further non compliance by the assessee, he would be at liberty to decide the appeal based on materials on record and in accordance with law.
In the result, the appeal stands allowed for statistical purposes.
