Income Tax Appellate Tribunal, ‘A’ BENCH: CHENNAI

Before: SHRI ABY T. VARKEY & SHRI S.R.RAGHUNATHA

Hearing: 07.04.2026Pronounced: 05.06.2026

आदेश / O R D E R PER ABY T. VARKEY, JM: This is an appeal preferred by the assessee against the order of the Learned Commissioner of Income Tax (Appeals)/NFAC, (hereinafter referred to as “the Ld.CIT(A)”), Delhi, dated 31.07.2025 for the Assessment Year (hereinafter referred to as "AY”) 2019-20.

2.

The main grievance of the assessee is against the action of the Ld.CIT(A) upholding the re-assessment order passed by the AO u/s.147/144B of the Income Tax Act, 1961 (hereinafter referred to as

ITA No.3161/Chny/2025 (AY 2019-20) Shri MU. Sampath Raja :: 2 :: "the Act”) confirming the action of the AO making addition of the entire cash deposit of Rs.2,02,34,700/- u/s.69A of the Act when the AO for AY 2017-18 & 2020-21 has estimated the income at 8% of the turnover.

3.

In AY 2017-18, the AO had reopened the assessment taking note that the assessee had made credit in the savings bank account (including cash deposit of Rs.21,59,050/-) in his Axis Bank account to the tune of Rs.82,54,294/- and finally after going through the relevant documents accepted that the assessee is doing vegetable trading business and assessed the profit by estimating at 8% of the total receipt of Rs.1,42,22,670/- which is Rs.11,37,814/- as against the assessee’s returned income of Rs.2,45,191/- u/s.148 of the Act by assessment order dated 18.03.2025 u/s.147/144B of the Act.

4.

Similarly for AY 2020-21, the AO had reopened the assessment taking note that the assessee has deposited cash in his Axis Bank account to the tune of Rs.72,80,300/- and deposited cash of Rs.35,48,700/- in ICICI Bank, and after going through the relevant documents accepted that the assessee is doing vegetable trading business and assessed the profit @ 8% of the total business turnover of Rs.3,15,91,749/- which is Rs.25,27,340/- as against the assessee’s returned income of Rs.4,50,820/- u/s.148 of the Act by passing assessment order dated 17.03.2025 u/s.147/144B of the Act.

ITA No.3161/Chny/2025 (AY 2019-20) Shri MU. Sampath Raja :: 3 ::

5.

The brief facts of the case are that the assessee didn’t furnish his return of income (RoI) and the AO received information that assessee had transaction of depositing cash of Rs.2,02,34,700/- in his bank account maintained with Axis Bank & SBI during the year under consideration. Hence, the AO reopened the assessment of the assessee for AY 2019-20 and asked the assessee to file return of income as well as to prove the nature & source of the credit in his bank account. The assessee filed return u/s.148 declaring an income of Rs.2,63,500/-. However, according to the AO, assessee was non-responsive to his multiple statutory notices issued u/s.142(1), 143(2) and SCN u/s.144 including SCN with proposed variations. Hence, finding no other alternative, the AO is noted to have added the entire credit of Rs.2,02,34,700/- u/s.69A of the Act and taxed u/s.115BBE of the Act vide assessment order dated 23.01.2024. Aggrieved, the assessee preferred an appeal before the Ld.CIT(A) who confirmed the action of the AO, inter-alia, by taking note that even at the appellate stage, the assessee neither produced any substantive nor verifiable evidence to counter the basis of the addition by not producing the relevant material.

6.

Aggrieved, the assessee is in appeal before this Tribunal.

ITA No.3161/Chny/2025 (AY 2019-20) Shri MU. Sampath Raja :: 4 :: 7. Having heard both the parties and after perusal of the records, we note that the assessee is aggrieved by the action of the AO adding the entire credit of Rs.2,02,34,700/- in his bank account u/s.69A of the Act. In this regard, the AO is noted to have made the addition since assessee didn’t respond to his statutory notices as noted supra. On appeal, though the assessee made an attempt to file certain documents the CIT(A) was of the view that the assessee didn’t file the requisite documents to substantiate the nature and source of the deposit in his bank account. Be that as it may, as noted at Para Nos.3 & 4 supra, the assessee’s own case for AY 2017-18 & 2020-21 had undergone scrutiny before the AO who found that assessee is doing the business of trading in vegetables and hence, he estimated the income @ 8%, which action came up before this Tribunal and the Tribunal is noted to have restricted the profit @ 3.5% of the turnover by deciding as under:

5.

Before us, the assessee is noted to have contested only the reasonableness of the estimation of profit sustained by Ld CIT(A). Thus, the Ld AR has restricted his plea for reasonable estimation of the income. According to the Ld.AR, the assessee is only a trader of perishable fruits like water- melon, seasonal fruits etc. Hence, he urges that considering the business of the assessee, the profit estimation of 8% is high and unreasonable. In this regard, he also brought to our notice that barring the captioned years under consideration & AY 2019-20 (where assessee has filed ITR u/s 148), the assessee has filed ITR u/s.139(1)/139(4) of the Act for AY 2018-19, AYs 2022- 23 to 2025-26. And also that assessee’s books of account have been duly audited for subsequent assessment years, barring AY 2017-18. In order to show that impugned profit estimation of 8% is high, assessee has filed the chart below, which captures the profit for the assessment years from AY 2018-

ITA No.3161/Chny/2025 (AY 2019-20) Shri MU. Sampath Raja :: 5 :: 19 to AY 2025-26 which, data are collated are noted to be culled from audited books of accounts of assessee:-

6.

From a perusal of the chart supra, and relevant documents, it is noted that other than the relevant assessment year 2017-18, the assessee’s books are regularly audited. And from a perusal of the earlier/subsequent results of the assessee, it is noted that net-profit shown by the assessee is in the range of 1.0039 to 2.4001%, whereas the AO has estimated the net-profit at 8% which according to us, is not based on any relevant material or comparables. Hence, reasonable profit rate needs to be adopted for computing the profit of the assessee. And for that we take note of the assessee’s book results which are found to be audited (supra), which information can be a guide to estimate the income of assessee. Hence we find from the history of the profits declared by the assessee’s shown (supra) that the average net profit ratio works out to approximately 2% on the turnover of assessee. Hence considering the nature of business of assessee, and audited book results of assessee, who deals with perishable fruits, vegetables etc, net profit of 3.5% shall be estimated as against the 8% estimated by AO. Hence, we restrict the impugned addition at 3.5% of the turnover and direct the AO to compute the net-profit @ 3.5% of the total turnover as income of the assessee from the vegetable/fruit trading business.

7.

Since we find that the AO has made similar estimation of profit at 8% of the turnover for AY 2020-21 and there is no change in facts and law, following our order for AY 2017-18 (supra), we restrict the impugned addition for AY 2020-21 at 3.5% of the turnover and hence, direct the AO to compute the net-profit @ 3.5% of the total turnover as income of the assessee from the vegetable/fruit trading business.

ITA No.3161/Chny/2025 (AY 2019-20) Shri MU. Sampath Raja :: 6 :: 8. In the result, appeals filed by the assessee are allowed. 8. Be that as it may, it is noted that for the relevant AY 2019-20, admittedly assessee didn’t participate during the assessment proceedings and hence, the AO didn’t had an occasion to scrutinize/verify the relevant documents including the financials for the relevant assessment year. Hence, we are of the view that the assessee’s documents for AY 2019-20 has to be verified by the AO. For such a proposition, we rely on the decision of the Hon’ble Supreme Court in the case of TIN Box Co. and wherein, it was held as under:

1.

It is unnecessary to go into great detail in these matters for there is a statement in the order of the Tribunal, the fact-finding authority, that reads thus : "We will straightaway agree with the assessee's submission that the Income-tax Officer had not given to the assessee proper opportunity of being heard." 2. That the assessee could have placed evidence before the first appellate authority or before the Tribunal is really of no consequence for it is the assessment order that counts. That order must be made after the assessee has been given a reasonable opportunity of selling out his case. We, therefore, do not agree with the Tribunal and the High Court that it was not necessary to set aside the order of assessment and remand the matter to the assessing authority for fresh assessment after giving to the assessee a proper opportunity of being heard. 3. Two questions were placed before the High Court, of which the second question is not pressed. The first question reads thus: "1. Whether, on the facts and in the circumstances of the case, the Tribunal was justified in not setting aside the assessment order in spite of a finding arrived at by it that the Income-tax Officer had not given a proper opportunity of hearing to the assessee?"

ITA No.3161/Chny/2025 (AY 2019-20) Shri MU. Sampath Raja :: 7 :: 4. In our opinion, there can only be one answer to this question which is inherent in the question itself: in the negative and in favour of the asses-see.

5.

The appeals are allowed. The order under challenge is set aside. The assessment order, that of the Commissioner (Appeals) and of the Tribunal are also set aside. The matter shall now be remanded to the assessing authority for fresh consideration, as aforestated. No order as to costs.

9.

In the light of the discussion, we set aside the impugned order of the Ld.CIT(A) and restore the assessment back to the file of the AO for de-novo assessment. The assessee is directed to file the relevant documents to substantiate the nature and source of the deposits in his bank accounts. The AO to frame assessment order in accordance to law after hearing the assessee.

10.

In the result, appeal filed by the assessee is allowed for statistical purposes.
