The present appeal filed by the assessee for A.Y. 2019-20 is against the order passed by the NFAC, Delhi under section 250 of the Income Tax Act, 1961, dated 25.11.2025.

2.

The only issue in this appeal is whether the assessee is entitled to deduction under section 80P(2)(a)(i) of the Act amounting to ₹ 37,71,984,

ITA No.255/Bang/2026 Page 2 of 3 even though the return of income was not filed within the due date prescribed under section 139 of the Act.

2.1 The assessee filed the return of income after the due date. Therefore, the Assessing Officer (AO) disallowed the deduction of ₹ 37,71,984 claimed under section 80P(2)(a)(i) by applying section 80A(5) of the Act. The ld. CIT(A) confirmed the disallowance.

3.

Aggrieved by the order of the CIT(A), the assessee filed the present appeal before the Tribunal.

4.

The learned Authorised Representative (AR) admitted that the return of income was filed after the due date. However, he submitted that the assessee had filed a petition under section 119(2)(b) of the Act on 19.04.2026 seeking condonation of delay. The petition is still pending. He requested that the matter be restored to the AO to decide the issue after the condonation petition is disposed of.

4.1 The learned Departmental Representative (DR) did not object to restoring the matter to the AO for fresh consideration after the decision on the condonation petition.

5.

We have considered the submissions of both parties and examined the records. It is not disputed that the return was filed late. Therefore, at present, the assessee is not eligible for deduction under section 80P(2)(a)(i) because of section 80A(5) of the Act. However, the assessee has filed a condonation petition under section 119(2)(b) of the Act, which is pending. If the delay is condoned by the competent authority, the
