ITA 7282/Mum/2025 Aquakraft Foundation

“The Ld. Commissioner of Income Tax (Exemption) ["CIT(E)"] erred in law and on facts in rejecting the application for registration under section 80G(5) (iii) of the Income Tax Act, 1961. Since, complete details and documents could not be furnished, ld. CIT(E) could not arrive at a satisfactory conclusion on the parameters for the purpose of granting desired registration. The application so made was rejected on the ground of non- compliance of notices issued by the ld. CIT(E).

3.1. Contention of the assessee in this regard is that it has made the submissions but the same have not been considered while passing the impugned order. For this, reference was made to the e-proceedings response acknowledgment vide No. 129658431100625 placed at page-6 and 7 of the paper book. CIT(E) for de novo meritorious consideration of the application filed by the assessee seeking registration u/s. 80G. The documents furnished in the paper book before us need to be considered by the ld. CIT(E) while processing the application moved by the assessee for registration u/s. 80G.
