Income Tax Appellate Tribunal, ‘D’ BENCH: CHENNAI
Before: SHRI ABY T. VARKEY & MS. PADMAVATHY.S
आदेश / O R D E R
PER PADMAVATHY.S, A.M: These appeals by the assessee are against the separate orders of the Commissioner of Income Tax (Appeals)/National Faceless Appeal Centre (NFAC), Delhi, (in short "CIT(A)") passed u/s. 250 of the Income Tax Act, 1961 (in short "the Act") both dated 19.12.2025 for Assessment Years (AYs) 2020-21. The orders of the CIT(A) are arising out of the penalty orders passed by the A.O u/s. 270A and 271AAC(1) of the Act.
The assessee is an individual and did not file the return of income for the year under consideration. The A.O noticed from the GST records and bank transactions that the assessee has carried out business activities and has also deposited substantial amounts of cash into the bank account. Since the assessee did not file the return of income, the A.O reopened the assessment by issue of notice u/s. 148 of the Act. The assessee did not file the return of income in response to the notice u/s. 148 of the Act and also did not respond to the notices issued calling for details. The A.O therefore completed the assessment u/s.147 r.w.s 144 of the Act assessing the income at Rs.6,04,54,287/-. The A.O subsequently initiated penalty proceedings u/s.270A and 271AAC(1) of the Act. the assessee did not respond to the notices issued during the penalty proceedings also and therefore the A.O levied a penalty of Rs.3,28,000/- for under-reporting of income in consequent to misreporting of income u/s. 270A of the Act. The A.O also levied penalty u/s. 270AAC(1) of the Act to the tune of Rs. 46,25,684/-. Aggrieved, the assessee filed further appeal before the CIT(A) against both the orders of penalty. There is a delay of 152 days in filing both the appeals before the CIT(A). The CIT(A) did not condone the delay and dismissed both the appeals in limine. The assessee is in appeal before the Tribunal against the order of the CIT(A).
There is a delay of 122 days in filing the appeal by the assessee. The assessee has filed condonation petition/affidavit stating the reasons in for delay in filing the appeal as extracted below:
“1. That I am not regularly subjected to income tax assessment proceedings and the impugned AY 2020-21 was the first time, proceedings were launched and order was passed in my case. I was not aware of the notices issued during the reassessment proceedings as well as during the penalty proceeding, as the Mail ID provided at that time in the ITBA Profile was not updated, as I am not accustomed to IT Portal operations and was only operating that portal for ITR filing purposes through consultant:
That the consultant so engaged during the relevant time did not update me regarding receipt of notices, due to which I could not participate during the Assessment Proceeding as well as during the Penalty Proceedings. Only on receipt of demand notice from the Jurisdictional IT Office, I came to know that multiple orders were passed in my case for AY 2020-21. Immediately, I approached the office of another consultant, with whose help, I updated my ITBA Profile properly with my Mail ID - rvshonda3372@gmail.com as Primary Mail ID and Mail ID-skg fca@yahoo.co.in as the Secondary Mail ID, which is that of the new consultant;
That with the assistance of new consultant, appeal was filed against the Reassessment Order and also the subject Penalty Order. While filing Form 35, consciously, the Primary Mail ID belonging to me being rvshonda3372@gmail.com was given for correspondences. Further, in S. No.17, I also mentioned my address for receiving notices by post. However, after filing of first appeal in November 2025, I did not receive notices in Mail ID provided in Form 35 as well as the Mail IDs updated in ITBA Profile. In bona fide belief that the proceeding is pending, I was waiting for notices;
That on 20th June, 2026, I incidentally visited the new consultant's office for discussing with ITR filing compliance for AY 2026-27. At that time, when the consultant logged into my IT Portal, it was discovered that the Ld. Commissioner (Appeals) had dismissed the first appeal filed against Penalty Order u/s.271AAC(1) vide Order u/s.250 dated 19/12/2025;
That when I informed that I did not receive any notice or even the order so passed in December 2025, it was further examined by the consultant and it was informed that the IT Portal shows that Hearing Notice was sent to Mail ID - senthilbalaji788@gmail.com and not to Mail ID provided in Form 35 and probably, the Order u/s.250 might also be sent to that ID itself;
That shocked by this Order u/s.250, the present appeal is now filed with delay. However, as I was not served with the notices and also the Order in the Mail ID provided in Form 35 nor in the Mail IDs updated in the portal as early as in October 2025, I was not aware of the same. Hence, I sincerely pray that the delay in filing this appeal may be condoned, the appeal may be heard on merits and justice be rendered.”
Having heard both the parties and perused the material on record, we are of the view that there is a reasonable and sufficient cause for the delay in filing the appeal before the Tribunal. Therefore, following the Hon’ble Supreme Court decision in the case of Collector, Land Acquisition Vs. MST.Katiji & Ors., (167 ITR 471) (SC), we condone the delay in filing the appeal and admit the appeal for adjudication.
We have heard the parties and perused the material available on record. The Ld. Authorized Representative (AR) of the assessee reiterated that the reasons as stated in the condonation petition before the Tribunal are the reasons for the delay before the CIT(A) also. The Ld. AR further submitted that the tax counsel appointed by the assessee did not provide proper support which resulted in non-appearance before the lower authorities. The Ld. AR also submitted that the appeal against the quantum additions made by the A.O is pending before the CIT(A) and yet to be disposed. The Ld. AR accordingly prayed that the present appeals against the penalty being consequential may also be remitted back to the CIT(A). Considering the facts and circumstances peculiar to assessee's case and in the interest of natural justice, we are inclined to give one more opportunity to the assessee. Accordingly, we condone the delay in filing the appeals before the CIT(A) and remit the appeals back to the CIT(A) with a direction to consider the issue pertaining to the penalty u/s. 270A and 271AAC(1) of the Act along with the quantum appeal and decide the issue in accordance with law. Needless to say that the assessee be given a reasonable opportunity of being heard. It is ordered accordingly.
In the result, both the appeals of the assessee are allowed for statistical purposes.
Order pronounced on 25th day of August, 2026 at Chennai.
