What did the Tribunal hold?

The Tribunal held that the assessee had discharged its initial onus by producing certificates from Bank of Baroda confirming that the three accounts were fixed deposits opened on 17-08-2013 and closed on 28-04-2014 and 07-01-2015 respectively. The Tribunal noted that the Assessing Unit under the Faceless Regime made the addition of Rs. 52,00,000/- under section 69A without proper verification of the assessee's submissions. Furthermore, the RTI information furnished by the AO did not specify the amount of Rs. 52,00,000/- as determined by the AO. Therefore, the entire addition made in the hands of the assessee was deemed to be without justification and liable to be deleted. The Tribunal did not explicitly address the grounds related to the validity of reopening under section 148 and section 151 approvals, focusing instead on the factual nature of the bank accounts and the lack of verification for the addition.

What were the facts?

The assessee, Pragnesh Rameshbhai Pandya, an individual, did not file a Return of Income for Assessment Year 2015-16. Information from the Insight portal indicated a property purchase of Rs. 62,00,000/- and a cash deposit of Rs. 52,00,000/- in Bank of Baroda during Financial Year 2014-15. A show cause notice under section 148A(b) was issued. The assessee responded that he did not have a Bank of Baroda account but held three fixed deposits (FDs) with the bank, which were pre-closed. The Assessing Officer (AO) issued a notice under section 148 and, upon non-response, made an addition of Rs. 52,00,000/- as income from undisclosed sources, citing non-compliance and lack of justification for cash transactions. The Commissioner of Income Tax (Appeals) confirmed the addition.

What were the issues?

1. Whether the reopening of assessment under section 148 was valid without independent verification of Insight portal information and without sharing approvals under section 151 (mixed law and fact). 2. Whether the addition of Rs. 52,00,000/- as cash deposit was justified under section 68/69C when the identified bank accounts were actually Fixed Deposit accounts where cash cannot be deposited (mixed law and fact). Assessee's arguments: The reopening was bad in law due to lack of independent verification and non-application of mind by the AO. The three bank accounts were FD accounts held jointly with his spouse, and the majority proceeds were credited to his spouse's account, not his. Therefore, the addition should be deleted. The AO erred in treating FD accounts as regular accounts for cash deposits. The AO also failed to share approvals under section 151. Revenue's arguments: The assessee did not produce details before the AO regarding the fixed deposits held in his wife's name, making the addition sustainable in law. The CIT(A) noted that the assessee admitted the amount was deposited in an account operated by his wife, but since the Insight portal flagged it in the appellant's name, and the appellant did not deny being a joint holder or having an association, the onus was on the appellant to provide conclusive evidence of ownership, financial capacity, and reason for deposit, which was not done.

Which sections of the Income-tax Act were involved?

This appeal is filed by the Assessee as against the appellate order dated 16-07-2025 passed by the Commissioner of Income Tax (Appeals), National Faceless Appeal Centre, Delhi, (in short referred to as “CIT(A)”), arising out of the reassessment order passed under section 147 r.w.s. 144B of the Income Tax Act, 1961 (hereinafter referred to as ‘the Act’) relating to the Assessment Year 2015-16.

I.T.A No. 1824/Ahd/2025 A.Y. 2015-16 2 Pragnesh Rameshbhai Pandya Vs. ITO

2.

Brief facts of the case is that the assessee is an individual and has not filed the Return of Income for the Asst. Year 2015-16. Information received in the Insight portal that the assessee has purchased an immovable property for Rs.62,00,000/- and made cash deposit in Bank of Baroda of Rs.52,00,000/- during the Financial Year 2014-15. Therefore a show cause notice u/s. 148 A(b) was issued to explain the above transactions. The assessee responded that he does not have bank account with Bank of Baroda. Whereas he had three fixed deposits with Bank of Baroda which were pre-closed on 28-04-2014 and 07-01-2015 receptively. Thus there is no cash deposit to the tune of Rs.52,00,000/- in Bank of Baroda.

3.

Therefore notice u/s. 148 was issued to the assessee on 31-03-2022 requesting to file the return. The assessee not responded to this 148 notice also. The assessee not filed Return of Income in response to notice u/s. 148, the Assessing Officer called for an information u/s. 133(6) from the Sub-Registrar and also from Bank of Baroda thereby made addition of Rs.52,00,000/- by observing as follows: 1. During the concerned A.Y. i.e. 2015-16 the assessee neither filed original ITR nor in compliance to Notice 148 of the Income Tax Act, 1961. 2. The notices u/s 142(1) of the Income Tax Act, 1961, were issued 11.11.2022 and 17.01.2023, but the assessee neither provided any submission regarding his source of income, Nature of business, information about the cash transaction and the bank statements of the concerned A.Y. nor submitted any documentary evidences in this regard. 3. Details of the Bank accounts of assessee is received that there are 3 Bank Accounts in the name of the assessee at DABHAN, GUJARAT bearing account nos. 03030300011808, 03030300011809, 03030300011810. It is also submitted that the accounts were opened on 17.08.2013 and were clsoed on 28.04.2014, 28.04.2014 and 07.01.2015 respectively. In reply submitted in response to notice u/s 148A(b) of the Income Tax Act, 1961 the assessee had stated that he doesn't have the said bank account during the said period and also categorically denied any transaction/cash deposits through these bank

accounts. But as informed by the Bank, the assessee has closed the account nos., 03030300011808 & 03030300011809 on 28.04.2014 and 03030300011810 on 07.01.2015. From above it is seen that, the accounts were active during the concerned A.Y. under consideration. But the assessee categorically denied the above fact and intentionally didn't provide the details of transactions in these Bank Accounts 4. In view of the above it is clear that during the course of Assessment proceedings, the assessee has neither provided any submission nor Bank Statement to verify the source of deposited Cash which is to the tune of Rs. 52,00,000/-. Which clearly signify that the assessee has nothing to say in this matter. Hence the cash deposited in the assessee's bank account is to be treated as income from the undisclosed source of the assessee and the same is proposed to be added to the total income of the assessee. 5. The assessee is also a non-compliant to the notices issued under various sections of the Income Tax Act, 1961. Which clearly signify that the assessee has nothing in the justification of the Cash Transactions carried out in his bank account. 6. Hence, the amount of Rs. 52,00,000/- is hereby proposed to be added to the income of the Assessee as income from undisclosed sources for the A.Υ. 2015- 16.

4.

Aggrieved against the reassessment order, assessee filed appeal before Ld. CIT(A). During the appellate proceedings, the assessee is submitted that the reopening of assessment passed on third party information received from Insight portal and without independent verification, enquiry and non-application of mind by the A.O. is bad in law and liable to be quashed. The three bank account No 03030300011808, 03030300011809, 03030300011 are not regular savings or current accounts, but are Fixed Deposit (FD) accounts held jointly by the assessee with his spouse, Smt. Sejal Pragneshkumar Pandya. The details of these FDs are as follows:

I.T.A No. 1824/Ahd/2025 A.Y. 2015-16 4 Pragnesh Rameshbhai Pandya Vs. ITO

FD Number FD Account Amount Closed On Closure Amount opening Date 03030300011808 17-08-2013 5,00,000/- 28-04-2014 4,94,781/- 03030300011809 17-08-2013 5,00,000/- 28-04-2014 4,94,781/- 03030300011810 17-08-2013 5,00,000/- 07-01-2015 4,95,554/-

4.1. The assessee also produced a certificate from Bank of Baroda that the majority proceeds of this fixed deposits were credited to the bank account of Smt. Sejal Pragneshkumar Pandya and not the bank account of the assessee. Thus the addition made on account of cash deposit of Rs.52,00,000/- is liable to be deleted.

5.

The Ld. CIT(A) considered the above submissions however confirmed the addition by observing as follows: 7.2 The appellant has contended that He has not maintained any account in Bank of India, and that the three bank accounts referred to by the AD were Fixed Deposit (FD) accounts which were subsequently closed The cash deposit of 152.00.000/- in Bank of Baroda was made by Mrs. S. P. Pandya in her account bearing number 03030100002719, IFSC BARB0DABHAN, and therefore, the deposit should not be brought to tax in the hands of the appellant. 7.3 From the appellant's own statement, it is admitted that the amount was deposited in the aforementioned account belonging to or operated by Mrs. S. P. Pandya. However, since the Insight portal flagged this transaction in the appellant's name, and the appellant has not denied being a joint holder or having an association with the said account, it is reasonable to infer that the appellant is either a primary or joint holder in the account In such a case, the onus is on the appellant to furnish satisfactory and conclusive evidence regarding The ownership of the funds.

I.T.A No. 1824/Ahd/2025 A.Y. 2015-16 5 Pragnesh Rameshbhai Pandya Vs. ITO

The identity and financial capacity of the person who deposited the amount The reason for deposit in an account associated with the appellant No such documentary evidence (e.g., affidavit from Mrs. Pandya, source of funds, confirmations, etc.) has been placed on record. In the absence of any cogent explanation or supporting documentation, the explanation offered by the appellant remains unsubstantiated. Additionally, the appellant has not denied the purchase of the immovable property valued at 62,00,000/- as flagged in the Insight portal. However, no separate addition has been made by the Assessing Officer on account of the said investment to avoid double taxation, given the possible overlap in the source of funds In view of the above facts and circumstances: The appellant has failed to explain the nature and source of the cash deposit of 152,00,000/-made in the account flagged by Insight. The explanation regarding the deposit by a third party is unsupported by any verifiable documentary evidence. The ownership of the account and the deposit remains linked to the appellant, either solely or jointly. Therefore, the addition made by the Assessing Officer is justified. The addition of 52,00,000/- made under section 68/69A of the Income-tax Act, 1961, is hereby confirmed. This ground is dismissed Hence, the appeal is dismissed.”

6.

Aggrieved against the appellate order, the assessee is in appeal before us raising the following Grounds of Appeal:

1.

The Ld AO grossly erred in reopening the case of the assessee u/s 148 without verifying and inquiring on the insight information. 2. The Ld AO grossly erred in reopening the case of the assessee u/s 148 without sharing with the assessee approvals obtained u/s 151 of the Act. 3. The CIT(A) has erred in law and fact in not appreciating the fact that the AO made addition of cash deposit for Rs 52,00,000/- by specifically referring to three Bank Account with Bank of Baroda bearing A/c No

I.T.A No. 1824/Ahd/2025 A.Y. 2015-16 6 Pragnesh Rameshbhai Pandya Vs. ITO

03030300011808, 03030300011809, 03030300011810, which actually are FD Accounts in which no cash can be deposited. 4. The Appellant reserves the right to add, alter, amend, or modify any of the grounds of appeal during the course of the appellate proceedings.

7.

Ld. Counsel appearing for the assessee submitted before us the information obtained under RTI from the Assessing Officer namely the notices issued u/s. 133(6) to Bank of Baroda and details of cash deposit. The information received Bank of Baroda makes it clear that the three accounts are fixed deposits opened on 17-08-2013 and closed on 28-04- 2014 and 07-01-2015 respectively. Thus the Assessing Officer is not correct making addition of Rs.52,00,000/- u/s. 68/69C of the Act and liable to be deleted.

8.

Per contra Ld. Sr. D.R. appearing for the Revenue strongly submitted that the assessee has not produced the details before the Assessing Officer are the fixed deposits held in the name of assessee’s wife. Therefore the addition made by the A.O. is sustainable in law.

9.

We have given our thoughtful consideration and perused the materials available on record. Though the assessee has not filed the Return of Income but produced copies of Certificate from Bank of Baroda that the three accounts relating to fixed deposits opened on 17-08-2013 for Rs.5,00,000/- each and closed on 28-04-2014 and 07-01-2015 respectively. Thus the assessee has discharged its initial onus cast upon it. However the Assessing Unit under the Faceless Regime without verification of the same made addition of Rs.52,00,000/- u/s. 69A of the Act, which in our considered view is without making verification and the submission of the assessee. The RTI information furnished by the A.O. also not specified the amount of Rs. 52,00,000/- as determined by the

Assessing Officer. Thus the entire addition made in the hands of the assessee is liable to be deleted.

10.

In the result, the appeal filed by the Assessee is hereby allowed.
