On going through the above grounds of appeal, we noted that the issues involved are identical for all these years except the difference in figures shown in the grounds of appeal and all the appeals were heard together. Accordingly, we are passing a common order for all the years.

4.

Briefly stated the facts of the case are that the assessee is a Consumers Co-operative Society, filed its return of income regularly declaring ‘Nil’ income. The case of the assessee was reopened under Section 147/148 after complying all the due procedures for reopening the case. Accordingly, notices were issued to the assessee as per the information available with the department. During the course of survey proceeding conducted on 12.01.2018 at the office premises of M/s Krishna Enterprises at 7 Ganpath Bagla Road, Block-C, Flat No. 514, 5th

10 ITA Nos. 1447 to 1451/KOL/2025 Malda Wholesale Consumers Cooperative Society Floor, Kolkata – 700070. During the course of statement recorded of Shri Manoj Kumar Rameka. He stated that he is providing bogus bills to Shri Sanjeev Kumar Behani as and when required through his following four entities:

(i) Shri Shyam Trading

(ii) Naba Durga Trading Company

(iii) RidhhiSiddhi Enterprises

(iv) Bhagwati Traders

5.

The bogus bills provided by Shri Manoj Kumar Rameka has given list of beneficiaries including the name of assessee Co-operative Society. As per information available on record, the assessee namely Malda Wholesale Consumer Cooperative Society Ltd. has availed bogus billing on account of purchases for the above noted amounts for the years separately. As per the investigation report the assessee has made transaction for the bogus purchases in the form of bogus billing for the abovementioned amounts in the respective years. The expenses claimed by the assessee are not allowable as per the provision of Income-tax Act. Accordingly, the assessee had escapement of income. During the course of reassessment proceedings, the assessee also filed various documents but the AO has not examined the documents properly. During the course of reassessment proceedings, we further noted that the AO has not

11 ITA Nos. 1447 to 1451/KOL/2025 Malda Wholesale Consumers Cooperative Society examined the documents in depth. We also observe that there is deficiency to prove the genuineness of the transactions carried out by the assessee. The Ld. Counsel strongly supported that the uniforms forms were directly collected by the concerned schools Teachers/Headmaster/Principal as per their requisition and number of students studying in the particulars schools, and distributed among the children of the concerned schools. therefore, there is no requirement to maintain the stock register by the society and he also referred to paper book, page no. 553 in Volume-III for A.Y. 2013-14 and stated that entire 5100/- uniform were distributed among the different schools, page number 556, 4300 uninforms, page number 558, 3700 uniforms, page number 559, 3500 uniform, page number 562, 4800 uninform, etc.

6.

On the other hand, the Ld. DR relied on the order of lower authorities and submitted that the submission made by the assessee that approximately 70% shareholding of the assessee is State Government, therefore, the purchase procedure adopted by the State Government is similarly applicable to the assessee. The procedure for the purchase adopted by the state Govt. ha not been followed, if the purchases are more than 50,000/- and no stock register was produced. During the course of assessment proceedings and transportation bills regarding the movement of goods was also not produced during the course of reassessment proceedings. He further objected for accepting

12 ITA Nos. 1447 to 1451/KOL/2025 Malda Wholesale Consumers Cooperative Society the additional evidence filed by the assessee under Rule 29 of the ITAT Rules and assessee was given ample opportunities to file the documents but it did not do so.

7.

Considering the rival submissions, we noted that the case of the assessee was reopened on the basis of statement recorded during the course of survey under Section 133A of the Act that the assessee was involved in purchase through bogus purchase bills as alleged and claimed as expenditure in the profit and loss account. In this regard to establish the genuineness of purchase the assessee filed number of documents including details of the requisition of uniform from the concerned school but there is no any evidence submitted regarding actual distribution among the school children, it needs to be examined. We noted from the documents that the uniforms classifications are made for class I to IV there is one size, class V and VI which is another size for boys and girls, how is it possible that class-I uniform has been provided to the class IV students the rates are same. There is very short gap between the meeting conducted for supply of books and invoices raised by the supplier. Accordingly, we remitting this issue back to the file of JAO for depth examination and the JAO is further directed to examine the supplier of goods to the extent of his satisfaction and decide the issue as per law after giving a reasonable opportunity of being heard to the assessee and the assessee is directed to appear before the Jurisdictional

13 ITA Nos. 1447 to 1451/KOL/2025 Malda Wholesale Consumers Cooperative Society Assessing Officer (JAO) and substantiate its case with cogent documents and not seek unnecessary adjournments for early disposal of the case. In case of failure, no second leniency shall be granted to the assessee.

8.

In the result, all the appeals are allowed for statistical purposes.
