Assessee by : Shri Siddesh Gaddi (Virtual) Revenue by : Smt. Rijula Uniyal, Sr. DR (Virtual) Date of hearing : 11.06.2026 Date of : 27.07.2026 pronouncement आदेश/ORDER PER VINAY BHAMORE, JM: This appeal filed by the assessee is directed against the order dated 27.09.2025 passed by Ld. CIT(A)/NFAC, Delhi for the assessment year 2021-22. 2. The assesse has raised the following grounds of appeal :-

1.

The Ld. A.O. and CIT/A) has erred in law and on facts in completing the assessment under section 143/3) read with section 147 without appreciating the material placed on record and without granting adequate opportunity of being heard, thereby violating the principles of natural justice.

2 ITA No.456/PAN/2025

2.

The Ld. CITIA) has further erred in sustaining the additions made by the Ld. A.O. in a mechanical manner without independently examining the reconciliation and documentary evidence submitted, resulting in an erroneous confirmation of additions; 3. The Ld.CIT(A) has erred in law and on facts in upholding the order of the Ld.AO in the manner that he did; 4. The Ld. A.O. and CIT(A) has erred in law in treating the assessment as complete on the basis of "available material on record" under section 143(3) read with section 147, despite the appellant furnishing explanations and reconciliation during the proceedings. The order is bad in law as it disregards the appellant's valid submissions. 5. The Ld. A.O. and CIT(A) has erred in law and on facts in considering gross receipts as per Form 26AS instead of the audited books of account and GST returns, without appreciating that TDS in Form 26AS is deducted on a payment basis and includes advances amounting to 21,42,05,063/-, which do not constitute sales of the year. 6. The Ld. A.O. has erred in making an addition of Rs.21,66,26,603/- treating the same as income from other sources solely based on mismatch, without considering the detailed reconciliation uploaded during e-proceedings and without demonstrating any suppression of income. The Ld. CIT(A) has also erred in confirming the same. 7. The Ld. A.O. and CIT(A) has erred in law and on facts in treating reimbursement of expenses amounting to 124,21,540/- as sales, despite the appellant explaining that such receipts are not in the nature of turnover and are netted off in the books as per accepted accounting principles and therefore the addition is arbitrary and unsustainable. 8. The Ld. CIT(A) has erred in rejecting the appellant's explanation regarding advances, billing variations, and the reconciliation of receipts without assigning cogent reasons and without calling for a remand report or causing any further enquiry, thereby rendering the findings perverse. 9. Without prejudice to the above, the Ld.AO/CIT(A) have erred in law and on facts in not appreciating that the alleged difference is revenue neutral and therefore there is no need for separate addition; 10. The Ld.AO/CIT(A) have erred in law and on facts in passing the order against the rule of consistency; 11. Since the subject addition is leading to double taxation, the same is not legally tenable; 12. The Ld.CIT(A) has erred in rejecting order for non-prosecution and the same is against the provisions of section 250(4) and 250(6) of the Act;

3 ITA No.456/PAN/2025

13.

The Ld. A.O. and CIT(A) have erred in levying interest under sections 234A, 234B, and 234C, which is consequential in nature and deserves to be recomputed after giving appropriate relief. 14. The Ld. A.O. and CIT(A) have erred in initiating penalty proceedings under section 270A, which are premature and not justified once th additions themselves are disputed. 15. The Appellant therefore prays that the additions and disallowances made may kindly be deleted in full and appropriate relief may be granted. 16. In the view of the above and other grounds that may be urged at the time of the hearing of the appeal, the Appellant prays that the appeal may be allowed in the interest of justice and equity. (Tax effect Rs. 66,38,357/-) On the basis of the above grounds and other grounds which may be urged at the time of hearing with the consent of the Honourable Tribunal, it is prayed that the order passed under section 143(3) r.w.s 144B of the Act, as upheld by the Commissioner of Income Tax (Appeals), be quashed and relief sought be granted.

3.

There is delay of 11 days as pointed out by the Registry in filing of this appeal before us. In this regard we have heard Ld. Counsels from both the sides and perused the application filed by the assessee for condonation of delay. We are satisfied with the reasons mentioned by the assessee in delay condonation application which is duly supported by an affidavit that the assessee was prevented by reasonable cause in not filing the appeal within the prescribed time limit. Accordingly we deem it appropriate to condone the delay and proceed to adjudicate the appeal.

4.

Facts of the case in brief are that the assessee is an individual and has furnished his updated return u/s 139(8A) of the IT act on 05.09.2022

4 ITA No.456/PAN/2025

by declaring an income of Rs. 25,76,420/-. The case of the assessee was selected for scrutiny and notices u/s 143(2) and 142(1) and show cause notices respectively were issued to the assessee. The Assessing Officer (AO) on the basis of difference of Rs. 1,66,26,603/- in receipt shown in audited profit and Loss account and receipt as per 26AS presume that the assessee has shown less turn over and accordingly after considering the reply of the assessee vide order dated 14.03.2024 completed the assessment proceedings u/s 143(3) r.w.s. 144B of the IT Act by determining the income of the assessee at Rs. 1,92,03,023/- as against the income of Rs. 25,76,420/-. The above assessed income includes addition of Rs. 1,66,26,603/- being undisclosed income from other sources.

5.

Being aggrieved with the above action of the Assessing Officer (AO) the assessee preferred appeal before Ld. CIT(A). Since the assessee remained absent Ld. CIT(A) dismissed the appeal filed by the assessee and consequently confirmed the additions made by the AO.

It is the above order against which the assessee is in appeal before this Tribunal.

6.

We have heard Ld. Counsels from both the sides and perused the material available on record. In this regard we find that it is the sole request of the counsel of the assessee that the matter may kindly be restored back to the file of the AO since the difference in receipt shown

5 ITA No.456/PAN/2025

in audited Profit and Loss Account and in the receipt appearing in Form 26AS is nothing but due to the fact that an amount of Rs. 1,42,05,063/- pertains to advance received against which no sales were made during the year under consideration however TDS was deducted by the opposite party. Apart from above it was also submitted that an amount of Rs. 24,21,540/- was representing reimbursement of expenses which also does not constitute sales however the same was considered by the assessee in his audited books of accounts by netting off as per accepted accounting principles. It was also the contention of the assessee that the turnover shown in the audited books of accounts duly matches with the GST returns as well. Accordingly it was the contention of the assessee that instead of remanding the matter back to the file of Ld. CIT(A), the matter may kindly be restored back to the file of the AO which will meet the ends of natural justice.

7.

Considering the totality of the facts of the case and in the interest of justice we deem it appropriate to set aside the order passed by Ld. CIT(A) and restore the matter back to the file of AO with a direction to pass assessment order afresh and as per fact and law after providing reasonable opportunity of hearing to the assessee. The assessee is also hereby directed to respond to the notices issued by the AO in this regard and to produce documents, evidences, submissions and reply in support of its contentions without taking any adjournment under any pretext otherwise

6 ITA No.456/PAN/2025

the AO shall be at liberty to pass appropriate orders as per law. Thus the grounds of appeal raised by the assessee are allowed for statistical purposes.

8.

In the result the appeal filed by the assessee is allowed for statistical purposes.
