In the present appeal Assessee has raised the following grounds:

1.

The impugned order is both against facts and erroneous in law and impugned order and void ab initio under section 148. 2. An appeal has been allowed in same cases by CIT(A) vide appeal no. ITBA/NFAC/S/250/2023-24/1056080912(1) dt. 14/09/2023 Harbans Singh Vs. CIT(A) grounds are same so kindly take into it.

3.

Briefly stated, the facts of the case, as emanating from the record, are that the assessee received interest on enhanced compensation on account of acquisition of land. The Assessing Officer treated such interest as taxable under the head “Income from Other Sources” in terms of section 56(2)(viii)

read with section 145B of the Act and after allowing statutory deduction under section 57(iv), brought 50% of such interest to tax.

4.

Against the order of the Ld. AO the assessee went in appeal before the Ld. CIT(A). The Ld. CIT(A) confirmed the addition by holding that the interest received under section 28 of the Land Acquisition Act is taxable in the year of receipt and does not qualify for exemption under section 10(37) of the Act.

5.

Aggrieved by the order of the Ld. CIT(A), the assessee is in appeal before us and has challenged the action of the lower authorities in treating the interest on enhanced compensation as taxable income.

6.

Per contra, the Ld. DR relied on the orders of the lower authorities.
