ITA No. 2262//Ahd/2025 Assessment Year 2019-20 Sanketkumar Jayantilal Thakkar Vs. ITO
Assessing Officer held that the assessee has not given the details of the donations and this addition of Rs. 5,00,000/- in respect of donations to various political parties.
Being aggrieved by the assessment order, the assessee filed appeal before the CIT(A). The CIT(A) allowed the appeal of the assessee.
The ld. A.R. submitted that the assessee has given all the details related to the donations to the political parties. Thus disallowance was not justifiable. The ld. A.R. relied upon the following decisions:-
(i) ACIT v. Armee Infotech (2022) 193 ITD 728 (ii) Abhishek J. Joshi vs. AC CIR (Mum-Trib) 2026 ITL 165 (iii) Chirag Bhikhabhai Patel vs. DCIT (Rajkot-Trib) 2026 ITL 1207 (iv) Suchismita Dhal vs. ITO (Rai-Trib) 2026 ITL 730 (v) ACIT vs. Anuj Praksh Gupta (Rai-Trib) 2026 ITL 924
The ld. D.R. relied upon the assessment order and the order of the CIT(A).
Heard both the parties and perused all the relevant material available on record. At the time of hearing, the ld. A.R. argued that the assessee has not been given the opportunity of cross-examination related to the parties upon whose statement the Assessing Officer is relied related to the disallowance of donations u/s. 80GGC. From the perusal of the records, it can be seen that the questions related to the said political parties and their officers was reproduced in the order but are not solely relied upon while making the disallowance by the Assessing Officer . In fact, the in para 3.4.2.2, the Assessing Officer
ITA No. 2262//Ahd/2025 Assessment Year 2019-20 Sanketkumar Jayantilal Thakkar Vs. ITO
has raised the basic questions related to the assessee’s family situations wherein the assessee was facing financial hardship and despite the same made the donations to these political parties. The explanation given by the assessee was insufficient at the time of the assessment proceedings as well as the assessee could not bring out any other relevant reason for making donations during the said period before the CIT(A) as well. Merely relying on the decisions of various Tribunals will not support assessee’s case as those case laws are factual centric and are given exclusively in related to the facts of those assessee’s cases and not be applicable in the present assessee’s case. Therefore, the matter is remanded back to the file of the Assessing Officer for proper adjudication and verification of the details.
In the result, the appeal of the assessee is partly allowed for statistical purpose. Order pronounced in the open court on 14-05-2026
