ORDER Per, Shri Sonjoy Sarma, JM: Captioned appeal filed by the assessee, pertaining to assessment year (AY) 2019-20, is directed against the order under section-250 of the Income-tax Act, 1961 (hereinafter referred to as ‘the Act’) passed by the National Faceless Appeal Centre (NAC) Delhi/Commissioner of Income-tax (Appeals) [in short ‘NFAC/Ld.CIT(A)’], dated 22.01.2026, which in turn arises out of an assessment order passed by the Assessing Officer u/s 147 of the Act, dated 12.03.2024.
ITA No.429/Rjt/2026 [ AY 2019-20 ] Lalitbhai Vallabhbhai Kotadiya v. ITO
Brief facts of the case are that for the assessment year 2019-20, assessee filed return of income declaring taxable income of Rs.5,18,630/-, which was processed by CPC u/s 143(1) of the Act. Thereafter, case of the assessee was reopened u/s 147 of the Act. Believing that certain cash transaction were made in order to purchase property from R.K. Group. Accordingly, proceedings u/s 147 of the Act was initiated. In this connection, assessee has filed its reply before the Assessing Officer however the submissions made by the assessee were not satisfaction to the AO accordingly. Assessing Officer made an addition of Rs.5,00,000/- to declared income of assessee and assessed the total income of assessee at Rs.7,18,630/-. 3. Dissatisfied with the above order, assessee preferred an appeal before the Ld. CIT(A), where the appeal of the assessee was dismissed due to delay in filing the appeal before the Ld. CIT(A). The delay was approximately 368-days and the appeal of the assessee was dismissed in limine without deciding on the merit of the case. 4. Still, aggrieved by the above order, assessee is in appeal before this Tribunal. At the time of hearing, Ld. AR stated that since the impugned order passed by the Ld. CIT(A) is only on the issue of technicalities and without adjudicating on the merit of the case therefore another chance may be given to the assessee so as to matter may adjudicate properly before competent authority. He therefore prayed that instant issue may be set aside to the file of Ld. CIT(A) with a direction to re-examine issue afresh after affording reasonable opportunity of being heard to the assessee and decide the appeal on the merit of the case. 5. On the other hand, Ld. DR relied on the decision of the authority below.
We after considering the rival contention of the parties and on perusing the material available on record. We find that in present case of the assessee, the appeal

of the assessee dismissed only on the issue of technicalities without looking into merit of the case, therefore interest of justice and fair play to find it necessary to remand back issue of the file of the Ld. CIT(A) with a direction to re-examine the issue afresh and decide the issues on merits after condoning delay.
In terms of above, appeal filed by the assessee is allowed for statistical purpose.
