The Ld. Dissatisfied with the above order, assessee preferred an appeal before the Ld. CIT(A), where the appeal of the assessee was dismissed due to considerable delay of 418-days in filing the appeal before the Ld. In the present case, the assessee has raised multiple grounds of appeal. However, the primary contention of the assessee is that the assessment order passed by A.O. is an ex-parte order. It is further submitted that the Ld. CIT(A) did not adjudicate the issue on merits and dismissed the appeal solely on the technical ground of delay in filing the appeal. Therefore, it was prayed that matter be restored to the file of the Ld. AO with a direction to decide the appeal afresh on merits after providing adequate opportunity of being heard to the assessee. 6. On the other hand, Ld. 7.

We after considering the rival contention of the parties and perusing the material available on record. We find that the assessment order passed by the Assessing Officer was an ex-parte and even before the Ld. CIT(A) appeal of the assessee was not adjudicated on merit of the case simply dismissed on the issue of limitation. Therefore, interest of justice and fair play we find it necessary to remand back issue to the file of the Assessing Officer with a direction to re- examine the issue afresh after affording adequate opportunity of being heard to the assessee. Assessee is also directed to comply with the notices issued by the Assessing Officer during remand proceedings.
