आयकर अपीलीय अिधकरण ”बी” ायपीठ चेई म। IN THE INCOME TAX APPELLATE TRIBUNAL CHENNAI BENCHES “B” :: CHENNAI BEFORE SHRI INTURI RAMA RAO, ACCOUNTANT MEMBER AND SHRI S.S.VISWANETHRA RAVI, JUDICIAL MEMBER आयकर अपील सं. / ITA No.2715/CHNY/2025 नधारण वष / Assessment Year: 2017-18 Subramanian Kavithra, Vs Deputy Commissioner of New No.4, Old No.7, Dr.Ambedkar Income Tax, Non-Corp Road, Kodambakkam, Circle-19(1), Chennai. Chennai – 600024. PAN: AANPK2268H Appellant / Assessee Respondent / Revenue Assessee by Ms. N.V.Lakshmi – Advocate Revenue by Ms. Gouthami Manivasagam – Addl.CIT Date of hearing 03/03/2026 Date of pronouncement 29/05/2026 आदेश/ ORDER PER INTURI RAMA RAO, AM : This appeal filed by the Assessee directed against the order of ld.Commissioner of Income Tax(Appeal)[NFAC] dated 31.07.2025 passed under section 250 of the Income Tax Act, 1961 for the A.Y.2017-18.

2.

The Assessee raised the following grounds of appeal : “1 The order of the Commissioner of Income Tax (Appeals) ["CIT (A)"] is against the law, the facts and circumstances of the case and the principles of equity and natural justice.

2.

The CIT(A) failed to appreciate that the Assessing Officer did not record any satisfaction in the assessment order regarding the default under section 44AB. Hence imposition of penalty under section 271B of the Act is wholly without any jurisdiction.

3.

The CIT(A) erred in upholding the penalty u/s 271B though the Assessing Officer, in the show cause notice, failed to specify the exact nature of default contemplated in section 271B of the Act. Therefore, the show cause notice issued under section 274 rws 271B and consequent order passed under section 271B of the Act is bad in law and liable to be treated as non-est.

4.

The learned CIT(A) erred in confirming the penalty levied u/s 271B without appreciating that the assessing officer had initiated penalty proceedings after an inordinate delay. Considering the rationale laid down by the Hon'ble Madras High Court in J. Srinivasan v. ACIT [2018] 404 ITR 51 (Mad) the impugned penalty proceedings is liable to be quashed.

5.

The CIT(A) failed to appreciate that the assessing officer had erroneously invoked provisions of section 271B of the Act for technical and venial breach, particularly when he had discretionary powers to drop the penalty proceedings under section 271B of the Act.

6.

The CIT(A) erred in confirming the penalty under section 271B of the Act imposed by the assessing officer without appreciating that the Appellant had filed audit report even before the initiation of scrutiny proceedings.

7.

The CIT(A) ought to have considered the reasonable cause furnished by the Appellant and ought to have dropped the penalty proceedings by considering the implication of section 273B of the Act

8.

The CIT(A) erred in holding that immunity under the Vivad Se Vishwas Scheme, 2020 was not available for penalty u/s 271B.

9.

Without prejudice, the CIT(A) failed to appreciate the bonaafide reasons that caused delay in filing the tax audit report. Hence, the delay was unintentional and not deliberate and the assessing officer ought not to have imposed penalty under section 271B of the Act.

10.

The Appellant craves the leave of the Hon'ble Tribunal to raise additional grounds before and during the course of hearing of this appeal.”

3.

Briefly the facts of the case are that appellant is an Individual and derives income from salary from Karpaga Vinayaga Educational Trust, Income from House Property, Income from Petrol Pump in the name of Karpaga Vinayaga Agencies and Lease Income from Kalyana Mandapam. The appellant trust filed Return of Income for the Assessment Year 2017-18 on 14.03.2018 disclosing Rs.63,60,400/- as income from Business and Other Sources.

4.

The Assessing Officer issued a notices u/s.143(2) and u/s.142(1) of the Act, and thereupon an order dated 16.12.2019 was passed u/s.143(3) of the Act assessing total income at Rs.70,87,652/-. Based on the assessment record, the Assessing Officer found that the appellant filed its Form 3CD on 10.041.2018 which was after the extended due date i.e.07.11.2017. In the circumstances, the Assessing Officer had initiated the penalty proceedings u/s.271B of the Income Tax Act, 1961 by levying penalty of Rs.1,50,000/- u/s.271B of the Act.

5.

Being aggrieved, an appeal was filed before the ld.CIT(A) who vide impugned order confirmed the action of the Assessing Officer.

6.

Being aggrieved, the appellant is in appeal before us in the present appeal.

7.

The issue that arises for our consideration is whether the Assessing Officer was justified in levying penalty proceedings u/s.271B of the Act while processing the Return of Income u/s.143(1) of the Act solely for the reason that the prescribed report in Form 3CD was filed belatedly.

8.

We heard the rival submissions and perused the material available on record. The issue that arises for our determination is whether the AO was justified in the facts of the case in levying penalty of Rs.1,50,000 u/s.271B of the Act for failure of the assessee to submit the prescribed audit report u/s.44AB of the Act, within the due date mandated u/s.139(1) of the Act. From the material on record, it transpires that the assessee had filed the belated return of income as well as the audit report as prescribed u/s.44AB of the Act. But, the Audit Report was very much available at the time of making the assessment. Therefore, it cannot be said that any prejudice is caused to the department on account of belated submission of the audit report as prescribed u/s.44AB of the Act. Further, the issue is squarely covered by the judgment of the Hon'ble jurisdictional High Court in the case of Chavakkad Service Co-operative Bank Limited (2024) 169 taxmann.com 45 (Ker.), wherein the Hon'ble High Court observed as under:- "Where assessee co-operative societies did not file audit report as mandated under section 44AB within time limit specified thereunder, however, audit reports were made available before Assessing Authority at time of finalization of assessments, since delay in obtaining audit reports from statutory auditors under Kerala Co-operative Societies Act and Rules could be seen as a reasonable cause for delayed submission of audit reports, no penalty under section 271B was to be imposed on assessee.” 9. We are of the considered view that the ratio of the above judgment is squarely applicable to the facts of the present case, and therefore, the Assessing Officer is not justified in levying penalty u/s.271B of the Act. Accordingly, we direct the Assessing Officer to delete the penalty.

10.

In the result, appeal filed by the assessee stands allowed. Order pronounced in the open Court on 29th May, 2026.
