Accordingly, the assessment was completed on best judgment basis as per the provisions of Section 144 of the Act, therefore, the order of Ld. AO needs to be sustained and the additions made therein deserves to be upheld. It is also submitted by the Ld. Sr. DR that the various documents and clarifications which are furnished before the Ld. CIT(A) are not referred to the Ld. AO for calling a remand report qua such information, therefore, there was a clear violation of Rule 46A by the Ld. Considering reply of the assessee, material available on record, no adverse view is taken on this account. 9.3 Based on the above submission made by the appellant and assessment order passed by the AO for AY 2015-16, AO is directed to delete the following addition made in the assessment order for AY 2014-15 (a) Variation in respect of Hawala Income- Rs. 7,00,00,000/- (b) Variation in respect of investment in house and income there from- Rs. 1,56,00,000/- Accordingly grounds of appeal no. 03 to 06 raised by the appellant is allowed.

8.

Referring to aforesaid findings of Ld. CIT(A), it is submitted by the Ld. AR that the entire additions made by AO were deleted by Ld. CIT(A), based on the assessment order for ensuing year i.e. AY 2015- 16.Therefore, there was no document furnished by the assessee before Ld. CIT(A) which could be treated in the nature of additional evidence to be subjected to proceedings as per Rule 46A. the need of following the provisions of Rule 46A does not arises, the contention raised by Ld. Sr. DR therefore cannot be acceded to. It was the prayer that order Page 7 of 9

ITA No. 2453/Mum/2025 Gazala Hassan Chariyari passed by Ld. CIT(A) was based on revenues decision in assessee‟s case for AY 2015-16, therefore, the additions made in current year cannot sustain. 9. We have considered the rival submissions, perused the material available on record and the assessment order of assessee of AY 2015- 16. Admittedly, the issue of Hawala has been examined in detail by the AO in next year and have not preferred to make any adverse inference on the issue. Therefore, in absence of any facts, contrary to the facts of AY 2015-16 in the instant year, no addition on this count is called for. Regarding the house purchased by the assessee, the identical issue for same house was raised in AY 2015-16, which has been considered as fully explained by the assessee and no adverse view has been drawn by the AO. Therefore, the issue which is for the same transaction, which has been picked for AY 2015-16, cannot be the basis for any inquiry for AY 2014-15 also. We find substance in the observations of AO for AY 2015-16, which led the Ld. CIT(A) to arrive at a conclusion that the issue raised in current year are not having any substance to draw any adverse inference to make additions in the hands of assessee. We, thus, do not find any adversity in the order of Ld. CIT(A), so far so as to interfere with the same. In the result, the appeal of revenue being bereft of merits, needs to be rejected, and we do so.
