Pillappa Seshakumar, Vs. DC/ACIT, 27, 4th Cross, N R Road, Circle – 5(1)(1), Bengaluru – 560 002. Bengaluru. PAN : ABJPS 4064 Q APPELLANT RESPONDENT Assessee by : Shri. J. V. Kodhandapani, CA Revenue by : Shri. Rahul Sinha, Addl.CIT(DR)(ITAT), Bengaluru. Date of hearing : 25.05.2026 Date of Pronouncement : 29.05.2026 O R D E R Per Balakrishnan S, Accountant Member : This appeal filed by the assessee against the order of learned Commissioner of Income Tax – Appeals (NFAC, Delhi) [in short “CIT(A)”] vide DIN No.ITBA/NFAC/S/250/2025-26/1085944905(1) dated 12.02.2026, for the Assessment Year 2017-18 arising out of the Order passed under section 271DA of the Act, dated 27.09.2024.
Brief facts of the case are assessee being an individual, filed his return of income for the Assessment Year 2017-18 declaring an income of Rs.69,45,413/-. The case was selected for scrutiny under Computer Assisted Scrutiny Selection (CASS). The learned Assessing Officer [in short “AO”]
ITA No.865/Bang/2026 Page 2 of 5
passed an order under section 144 of the Act on 09.10.2019 by determining the income at Rs.3,46,56,715/-. The assessee filed appeal before the learned CIT(A) which was dismissed. The appeal before the Tribunal was filed by the assessee wherein the Tribunal set aside the matter. On reopening of the assessment, the learned AO accepted the returned income of Rs.69,45,413/- declared in the original return filed by the assessee. However, the learned AO noticed that assessee has received cash amounting to Rs.7,45,000/- in contravention of section 269ST of the Act. He therefore initiated penalty proceedings under section 271DA of the Act and thereby levied penalty of Rs.7,45,000/- equal to the amount received in cash by the assessee.
Aggrieved by the order of the learned AO, assessee carried the matter before the learned CIT(A). The learned CIT(A) observed that certain transactions were entered into during the Financial Year 2015-16 relevant to Assessment Year 2016-17 and therefore deleted an amount of Rs.5,25,000/-. The learned CIT(A) however sustained the penalty of Rs.2,20,000/- since the transaction is dated 09.04.2016 and relevant to Assessment Year 2017-18.
Aggrieved by the order of the learned CIT(A), the assessee is in appeal before us by raising various grounds. The only issue emanating from the above ground is with respect to confirmation of penalty under section 271DA of the Act amounting to Rs.2,20,000/-. On this issue, the learned AR submitted that section 269ST of the Act was introduced with effect from 01.04.2017 by the Finance Act, 2017. He further explained that the transaction of receipt of cash happened on 09.04.2016 which is well before the enactment of the Finance Act, 2017. He further pleaded that the section 269ST of the Act and the relevant penalty under section 271DA of the Act cannot be applied retrospectively since
ITA No.865/Bang/2026 Page 3 of 5
the transaction occurred before the enactment of Finance Act, 2017. On this issue, he relied on the decision of Co-ordinate Bench of Delhi in the case of Krishna Wanti Vs. JCIT in ITA No.158/Del/2023.
Per contra, the learned Departmental Representative [in short ‘DR’] relied on the orders of Revenue authorities and could not controvert the fact argued by the learned AR.
We heard both the sides and perused the material available on record including the written submissions of the assessee. The main contention of the learned Authorized Representative [in short ‘AR’] is that the transaction of sale of tractor took place on 09.04.2016 which is evidenced by receipt No.14169 dated 09.04.2016 for Rs.2,20,000/-. The submission of learned AR was section 269ST of the Act was introduced by the Finance Act, 2017, w.e.f. 01.04.2017 and therefore the consequent penalty u/s 271DA shall be applied for transactions entered prospectively. In the instant case, we noticed that the Ld AO invoked section 269ST of the Act and levied the penalty under section 271DA of the Act for a transaction which took place on 09.04.2016 before the enactment of the Finance Bill 2017 which in our opinion is not justifiable. There is merit in the argument of the learned AR that the relevant provisions cannot be applied retrospectively as it was not in force when the transaction was executed. There is also no indication in the Finance Act, 2017, that section 269ST of the Act was intended to be applied retrospectively to transactions occurred prior to introduction. Under similar circumstances the co-ordinate Bench of Delhi in the case of Krishna Wanti (supra) held as follows:
ITA No.865/Bang/2026 Page 4 of 5
We have heard the rival submission and have perused the materials on record. We find that the provisions of section 269ST and penalty u/s 271DA was brought in the statutes by the Finance Act, 2017 w.e.f 1.4.2017. We find that the transaction in question took place on 23.05.2016, well before Section 269ST and 271DA was enacted. We are therefore of the considered view that the provisions of section 269ST and 271DA cannot be applied retrospectively, as the law did not exist at the time of the transaction. It is a well-established principle that penal tax provisions cannot be applied retrospectively unless the statute expressly provides for such application. In this case, there is no indication in the Finance Act, 2017 that Section 269ST was intended to apply retrospectively to transactions that occurred prior to its introduction. In view of the above, we hold that the upholding of penalty is not legally valid.
In view of the facts and circumstances as discussed above, and by following the decision of the co-ordinate Bench of Delhi, we are of the opinion that invocation of penalty under section 271DA r.w.s. 269ST of the Act cannot be justified and therefore we direct the AO to delete the same. Accordingly, the grounds raised by the assessee are allowed.
In the result, the appeal of the assessee is allowed.
