At the outset of hearing, we noted that the assessee carried on the business of electronic goods under the name and style as M/s Lucky Enterprises at Kakat Square, Kendrapara. The assessee filed return of income on 13.12.2017 in ITR-3 declaring total income of Rs. 4,38,230/- . Subsequently, the case was selected for Limited Scrutiny under CASS to verify cash deposits during the year. Accordingly, notice u/s 143(2) of the Act was issued. Subsequently, other statutory notices were issued to the assessee on verification of documents. It was noted that the assessee maintained a bank account with Andhra Bank Kakat, A/c No. 140711000000539. There is total credit shown at Rs. 1,96,08,242/- out of which cash deposit is of Rs. 10563450/-. In the Profit & Loss Account the assessee has shown sale of goods of Rs. 34,54,046/- and sales of services of Rs. 13,69,890/- totalling to Rs. 48,23,936/- whereas vide figure shown sale of Rs. 34,54,046/-. Accordingly, it was seen that excess credit of Rs. 1,47,84,306/- (Rs. 1,96,08,242/- (-) Rs. 48,23,936/- ) over the total revenue operation, the excess credit was found in the bank account including cash credit excess credit was treated as unexplained money, for want of proper explanation u/s 69A of the Act. Further, it was noted that during the demonetisation period the assessee
4 ITA No. 143/CTK/2026 Anjulata Behera deposited cash in SBN’s of Rs. 3,20,000/- which was also treated as unexplained money u/s 69A of the Act. Accordingly, assessed the income of Rs. 1,55,42,530/-.
Aggrieved from the above order, the assessee filed appeal before the Ld. CIT(A). During the appellate proceedings, the assessee has not offered acceptable and cogent explanation regarding the source of such deposits found in the bank account. Accordingly, he dismissed the appeal of the assessee.
Aggrieved from the above order, the assessee filed appeal before the ITAT.
The Ld. Counsel reiterated the grounds of appeal (supra) submitted that no proper opportunity was granted to the assessee to explain the source of cash deposits. Further, requested and undertook that the one more chance may be given to the assessee and assessee will be able to explain the source of cash deposits.
On the other hand, the Ld. DR relied on the order of lower authorities and submitted that the assessee has deposited cash over and above the turnover shown in the VAT return of Profit & Loss Account and the difference was not explained at both the levels.
Considering the rival submissions here the issue is regarding cash deposits and the case was selected for scrutiny only on the points
5 ITA No. 143/CTK/2026 Anjulata Behera regarding the cash deposits as per observation of the AO. It was seen that the cash deposits are more than turnover reflected in the P & L account and VAT return. We also noted that during the appellate proceedings, the case was not properly represented. Considering the prayer of the ld. counsel, interests of justice and facts of the case, we are remitting this issue back to the file of AO for fresh adjudication and decide the issue as per law after giving a reasonable opportunity of being heard to the assessee. The assessee is directed to substantiate his case with cogent documents in support of his claim and not seek unnecessary adjournments for early disposal of the case. In case of failure, no second leniency shall be granted to the assessee.
In the result, appeal of the assessee is partly allowed for statistical purposes.
