P a g e | 1 ITA No.1630/JPR/2025 Om Kothari Foundation IN THE INCOME TAX APPELLATE TRIBUNAL, JAIPUR BENCHES, “SMC” BENCH, JAIPUR BEFORE SHRI SANJAY GARG, JUDICIAL MEMBER ITA No.1630/JPR/2025 (Assessment Year:2016-17) Om Kothari Foundation Vs. ACIT Central Circle 1, Om tower, M.I. Road, Jaipur Jaipur 302001 थायीलेखासं./जीआइआरसं./PAN/GIR No:AAATO0616J Appellant .. Respondent Appellant by : None Respondent by : Sh. Gaurav Awasthi, JCIT Date of Hearing 18.03.2026 Date of Pronouncement 21.04.026 O R D E R The present appeal has been preferred by the assessee against the order ofLd. Commissioner of Income Tax (Appeals) (hereinafter referred to as “Ld. CIT(A)”) dated 26.09.2025, passed u/s 250 of the Income Tax Act, 1961 (in short “the Act”).
An application for adjournment has been moved on behalf of the assessee; however, I find no sufficient ground for adjournment of the appeal. Therefore, the application of the assessee for adjournment is hereby dismissed. I proceed to decide the appeal of the assessee on merits after going through the record and hearing the Ld. DR.
P a g e | 2 ITA No.1630/JPR/2025 Om Kothari Foundation 3. The assessee in this appeal has taken following grounds of appeal:-
That the Ld. A.O. grossly erred on Law and Facts in not accepting the order of Higher Authorities on the same issues which has got finality and on which A.O. again made the additions, hence the order is null and void. Should be quashed. That the Ld. CIT(A) erred in non adjudication the Ground in proper way. That the order of higher Authorities not taken seriously. 2. That the Ld. A.O. grossly erred on law & facts in disallowing Income Tax expenses Rs. 1653830/-. Though it is part of application for Institution registered u/s 12(A)(a) of IT Act, 1961. That the Ld. CIT(A) also erred in not allowing the above expenses & Ground. 3. That the Ld. A.O. grossly erred on Law and facts in disallowing by stating to the under reporting of interest income Rs. 163920/-That the Ld. CIT(A) also erred in not considering the ground & not allowing the said amount of Rs. 163920/-. 4. That the Ld. A.O. made different calculation then what is as per Law & had reduced the application of income which is not justified. That Ld. CIT(A) directed the Ld. A.O. to recompute the income, hence this is set-asided & the Ld. CIT(A) have no power to remand OR set aside the Case. 5. That Appellant, craves to leave, add, alter the grounds of Appeal.
A perusal of the above grounds of appeal would reveal that assessee has taken two effective grounds; firstly, disallowance of income tax expenses of Rs.16,53,830/- and secondly, addition of income of Rs.1,63,920/- on account of suppressed interest income. 5. So far as the issue of addition on account of income tax expenses of Rs. 16,53,830/- is concerned, the assessee submitted before the lower authorities that the assessee is a charitable organization and that as per the various decisions of the Higher Courts, payment of taxes should be treated as application of income towards charitable objects of the
P a g e | 3 ITA No.1630/JPR/2025 Om Kothari Foundation assessee-trust. The assessee in this aspect relied upon the decision of the Hon’ble Gujarat High Court in the case of CIT Vs. Ganga Charitable Trust Funds [Gujarat] [1993] (115 CTR 93) and of the Hon’ble Madras High Court in the case of Janki Ammal AYYA Nadan Trust {1982} 153 ITR 159, wherein it has been held that in case of a charitable trust, the tax paid is the application of funds.
The ld. CIT(A), however, observed that the assessee has claimed the tax deducted at source (TDS) as its expenditure and that such TDS deducted at source was subject to refund on filing of the return. He, therefore, disallowed the said expenditure claimed on account of TDS deducted.
I have gone through the record and heard the Ld. DR. No doubt, the TDS deducted can be claimed at the time of filing the return. The assessee trust is a charitable organization and its income is exempt u/s 11 of the Act and, under these circumstances, there is no question of payment of any tax so far as the income of the assessee as a charitable organization is concerned. The TDS, if any, deducted by any party is subjected to refund. It can not be said to be application of income. Under such circumstances, the deduction of TDS cannot be claimed as an expense/application of income. I do not find any infirmity in the order of the Ld. CIT(A) in this respect.
P a g e | 4 ITA No.1630/JPR/2025 Om Kothari Foundation 8. The second issue is relating to the suppressed interest income. Though the plea of the assessee is that the assessee has taken into account only the interest income received and has not considered the interest accrued, however, if any amount of TDS paid is refunded to the assessee, the same will not be taxable.
However, the Ld. CIT(A) has noted that the bank has duly deducted the TDS on such amount. The action of the lower authorities is upheld in taking the interest income of Rs.33,56,744/- as against the interest income shown by the assessee of Rs.31,92,824/-. However, the said difference of the interest received is subject to the claim of deduction u/s 11 of the Act. If the assessee demonstrates to the AO that the difference of the income is also covered under the relevant provisions of Section 11 of the Act regarding application of income/accumulation etc., then no addition will be warranted.
With the above observation, the appeal of the assessee is treated as allowed for statistical purposes. Order is pronounced under provision of Rule 34 of ITAT Rules, 1963 on 21.04.2026.
