These notices have been sent to me by Shri Manoj Kothari, Karta of HUF on my email id grb787@gmail.com. 6. That with the hearing notices from CIT(A), we approached a Chartered Accountancy firm namely M/s. A.T. Jain and Co who asked us to provide various documents. Pending the collation of documents, I took an adjournment on 21/04/2025 against the notice issued on 04/04/2025. Copy of acknowledgement enclosed and forms part of this affidavit. 7. That another notice dated 10/11/2025 issued by CIT(A) has been sent to me by Shri Manoj Kothari fixing the date of hearing on 19/11/2025. However, due to my pre-occupation of finalizing the schedules/annexures of tax audit report as an accountant in my other client's case; I inadvertently and due to mistake missed to comply with this notice. 8. The assessee had filed the return and assessee’s case was reopened related to this transaction with bogus entry operator. 4 ITA No.9397/Mum/2025 Indarmal Magrajji Kothari (HUF) Rs.82,24,207/-. The Ld. CIT(A) had passed the order in exparte and uphold the addition. The Ld. AR in argument demonstrated that the assessee had complied the notice during the assessment and in appeal proceeding and filed the adjournment for filing evidence in support of its claim. But none of the authorities had made any remark in the impugned orders related to the part compliance of the assessee. The affidavit of the karta of the assessee and the accountant are duly submitted for explanation non-compliance before the revenue authorities. In our considered view, the reasonable opportunity for the assessee was denied in both the stages. Hence, we restore the matter to the file of Ld. CIT(A) for denovo adjudication. We are not expressing any view on merits of the case as the appeal proceeding should be uninfluenced. Needless to say that assessee should get a reasonable opportunity in set aside proceeding and any evidence wants to file should be allowed as per the law. On the other hand, the assessee should be diligent and cooperative in set aside assessment proceeding. 6. In the result, the appeal of the assessee bearing ITA No.9397/Mum/2025 is allowed for statistical purpose. Order pronounced in the open court on 20th day of May 2026.
