Income Tax Appellate Tribunal, GUWAHATI ‘DB’ BENCH AT KOLKATA

Before: SHRI SONJOY SARMA & SHRI RAKESH MISHRA

PER RAKESH MISHRA, ACCOUNTANT MEMBER:

This appeal filed by the assessee is against the order of the Commissioner of Income Tax (Appeals)-NFAC, Delhi [hereinafter referred to as Ld. 'CIT(A)'] passed u/s 250 of the Income Tax Act, 1961 (hereinafter referred to as ‘the Act’) for AY 2020-21 dated 06.01.2026. 1.1 The order of the Ld. CIT(A) was passed on 30.01.2025. The Registry has not pointed out any delay in filing the appeal. However, the assessee has filed an affidavit for condonation of delay, if any, in filing the appeal before the Tribunal. The reasons for the delay are stated to be the non-receipt of the appellate order and the assessee having knowledge of the order only when the demand notice dated 01.07.2025 was received. The assessee has prayed in the interest of justice for condonation of delay, if any, in submitting the appeal. On going through Nasiruddin Ullah Syed (Through Legal Heir Rizwan Uddin Ullah). the petition seeking condonation of delay, we are satisfied that the assessee had sufficient cause for the delay, the delay is condoned and the appeal is admitted for adjudication.

2.

The assessee is in appeal before the Tribunal raising the following grounds of appeal: “1) For that impugned order of appeal passed by the National Faceless Appeal Centre (NFAC) is bad in law as well as on facts and procedure. 2) For that National Faceless Appeal Centre (NFAC) has acted erroneously in passing the order without issuance of notices fixing the date of hearing. 3) For that NFAC is not justified in dismissing the appeal without giving reasonable opportunity of being heard to the assessee. The Ld. CIT(A) erred in refusing to condone the delay of 163 days in filing the appeal. The Ld. CIT(A) failed to appreciate that the delay was due to “sufficient cause”, specifically the death of the original assessee, subsequent family disputes, and the resulting communication gap among legal heirs. The Ld. CIT(A) ought to have taken a liberal and pragmatic approach to advance substantial justice rather than dismissing the appeal on technical grounds. 4) The appellant craves leave of you to take additional grounds of appeal and to modify or resign any grounds of appeal before or at the time of hearing.”

3.

Brief facts of the case are that the assessee is an individual and had filed the return of income for the AY 2020-21 showing total income of ₹ ‘NIL’. Aggrieved with the assessment order, the assessee filed an appeal before the Ld. CIT(A), who noted that the appeal was delayed by 163 days before him. The assessee requested to condone the delay but in the absence of any plausible explanation for the delay, the Ld.
