Briefly stated facts of the case are that the assessee is a Partnership firm engaged in the business of manufacturing and trading of gold and diamond jewellery. It filed its return of income declaring total income of 79,51,930/-. The case was selected for complete scrutiny. However, despite issuance of several notices for hearing, calling for various details and supporting documents, the assessee failed to furnish complete details, ledger accounts, and supporting evidence in respect of direct expenses and indirect expenses. The Assessing Officer therefore, made the estimated additions determining total income of Rs. 1,44,44,113/-.
In the subsequent appeal before the first appellate authority, there was no compliance by the assessee. Accordingly, the ld.CIT(A) upheld the additions made by the AO dismissing the appeal 5. Before us, the ld.AR has submitted that the above non compliance occurred mainly on account of the fact that the Accountant looking after the matter did not bring to the notice of the assessee of the notices received. The said person did not even share the e-portal password with the assessee. It is further stated that the management lodged an FIR also against the said employee. It is pleaded to send back
P a g e | 4 A.Y. 2023-24 MK Diamond Mountings the entire matter to the lower authorities for fresh consideration allowing the assessee one final opportunity to canvass the grounds. The ld.DR did not have any objection.
We have heard the rival parties and perused the material available on records. It is the fundamental duty of the assessee to diligently pursue the assessment and appeal proceedings and comply with the notices and proceedings initiated by the Revenue authorities. Some element of casualness is very much apparent from the conduct of the assessee before the lower authorities. However, it is equally true that the principles of natural justice and fairplay demand that the matter is verified and revisited at the level of AO and accordingly, we are of the considered view that the matter should be remanded back to him for framing de novo assessment order while applying the principles of natural justice after affording sufficient opportunity of being heard to the assessee. The assessee would be at liberty to adduce additional grounds /evidences in order to canvass its case before the AO. We order accordingly, setting aside the appellate order and allowing the grounds of appeal for statistical purposes.
In the result, the appeal is allowed for statistical purposes.
