AVKASH RAMESHCHAND JAIN,NAGPUR vs. DCIT/ACIT CIRCLE-4, NAGPUR
What did the Tribunal hold?
The Tribunal condoned the delay in filing the appeal before both the ITAT and the CIT(A) due to the reasons of ill health. The Tribunal found that the NFAC had dismissed the appeal for delay and then proceeded to decide on merits without addressing the legal issue, which is procedurally incorrect.
What were the facts?
The assessee's appeal was filed with a delay of five days before the ITAT, citing ill health. The appeal before the CIT(A) was also filed with a delay of four days due to the illness of the appellant's counsel. The NFAC had dismissed the appeal without condoning the delay and also made observations on merits.
What were the issues?
Whether the delay in filing the appeal should be condoned and whether the NFAC's procedure of dismissing for delay and then deciding on merits was correct.

Income Tax Appellate Tribunal, NAGPUR BENCH :: NAGPUR
PER ANUBHAV SHARMA, JM:
This appeal filed by the assessee is directed against the order of Ld. Commissioner of Income Tax (Appeals)/NFAC, Delhi, (for short, “CIT(A)”), dated 03/12/2024 passed under section 250 of the Income Tax Act, 1961 (for short, “Act”) which is emanating from the assessment order dated
ITA No. 69/NAG/2025 (Avkash Rameshchand Jain) 22.03.2024 passed u/s. 143(3) r.w.s. 144B of the Act by the ITO, for the Assessment Year (AY) 2019-20.
On hearing both the sides, we find that the assessee’s appeal before this Tribunal is filed with delay of five days for which an application for condonation of delay has been filed asserting that as assessee was suffering from ill health in the month of January. There was a delay of five days in filing the appeal before this Tribunal. However, it comes up that the assessee’s appeal before Ld. First Appellate Authority was also filed with delay of four days and for which the assessee had asserted the reason was illness of counsel of the appellant.
We find that National Faceless Appeal Centre, (“NFAC") has dismissed the appeal of the assessee without condoning the delay and further has also made observations on merits of the case. Ld. Counsel has further submitted that in fact the assessee had raised legal ground by relying on decision of Hon'ble Bombay High Court in the case of Hexaware Technologies Ltd. vs. Assistant Commissioner of Income Tax
ITA No. 69/NAG/2025 (Avkash Rameshchand Jain) and Others (Writ Petition no. 1778/2023). It was submitted that in fact relying on this decision, the assessee had succeeded in earlier years by way of Writ Petition no. 5290/2024. However, NFAC has not considered this decision.
Ld. DR has submitted after amendment in the Act w.e.f. 01.02.2026 the ground is not more applicable. After considering all the aspects, we are of the considered view that as the delay in filing of the appeal before this Tribunal or before the Ld. CIT(A) was not a very substantial period, the plea raised on ill health of assessee or counsel should reasonably be accepted. Accordingly, we condone the delay in filing the appeal before this Tribunal and so also before National Faceless Appeal Centre, Delhi.
However, we find that NFAC has proceeded to decide on merits also without deciding the legal issue and more so after dismissing the appeal for delay which is a procedure not known to law.
In the light of the aforesaid, we allow the appeal of the assessee here for statistical purposes and restore the issues
ITA No. 69/NAG/2025 (Avkash Rameshchand Jain) on merits as well as law to the facts of Ld. CIT(A) to give afresh opportunity of hearing to the assessee and pass an order afresh.
In the result, appeal of the assessee is allowed for statistical purposes.
