P a g e | 2 ITA No. 1675/JPR/2025 Kamla Lamba 2. The assessee in his appeal has taken following grounds of appeal:-
“Ground 1 On the facts and in the circumstances of the case, the Ld. Assessing Officer erred in issuing the notice under section 1 148 of the Income Tax Act, 1961, on the basis of the difference in stamp duty valuation of the property, which is illegal, unjustified, and bad in law. “Ground 2 On the facts in the circumstances of the case as well as law ld. Ground Assessee deserves right to amend, alter, DLEETE and modify any ground of appeal on OR before the due date of hearing of appeal.”
At the outset, the ld. Counsel for the assessee has invited our attention to the impugned order of the ld. CIT(A) to submit that the ld. CIT(A) has dismissed the appeal of the assessee holding the same as barred by limitation for a delay of one day only in filing the appeal. The Ld. Counsel has submitted that the assessee was under the bona-fide impression that the limitation for filing the appeal before the ld. CIT(A) was one month, whereas, in fact, it was 30 days, under such confusion, a delay of one day has occurred.
Considering the above submissions, we are of the view that the minor delay of one day in filing the appeal before the ld. CIT(A) is required to be condoned. Accordingly, the impugned order of the Ld. CIT(A) is set aside. The delay of one day in filing the appeal before the ld. CIT(A) is
