अपीलाथ ारा/Appellant represented by: Mr. S.Sridhar (Erode), Advocate थ ारा/Respondent represented by: Mr. Madhan Kumar – Sr.DR सुनवाई की तारीख / Date of conclusion of hearing: 31.07.2026 घोषणा की तारीख / Date of pronouncement: 24.08.2026 आदेश / ORDER PER INTURI RAMA RAO, ACCOUNTANT MEMBER : These two appeals filed by the Assessee are directed against the separate orders passed by learned Commissioner of Income Tax(Appeal)[NFAC] dated 06.01.2025 and 19.02.2025 respectively; passed u/s.250 of the Income Tax Act, 1961 for the Assessment Year 2018-19. 2. Since identical facts and issues are involved in both these appeals, these appeals were heard together and disposed of by this common order. For the sake of clarity and convenience the facts relevant in the ITA No.1977/CHNY/2026 are stated herein:

2.

The Assessee raised the following grounds of appeal : “1. The Impugned Order is bad in law and erroneous.

2.

Without prejudice, the Learned Commissioner (Appeals), even in the absence of replies from the legal heir of the Appellant, erred in not considering the records available and the averments made in Form 35, causing prejudice to the Appellant.

3.

Without prejudice, the Learned Commissioner (Appeals) and the Assessing Officer also erred in not considering the past history of the Appellant and also that the Agricultural Income declared at similar extent was considered and accepted by the Assessing Officer for immediately preceding Assessment Years, causing prejudice.

And for other reasons that may be adduced at the time of hearing, the Appellant prays that the delay in filing the present appeal be condoned, the appeal be admitted, considered and justice be rendered.”

ITA No.1977/CHNY/2026 : 3. Briefly, the facts of the case are that the appellant is an Individual. The appellant filed return of income under the provisions of section 139 of the Act on 31.10.2018 for the Assessment Year 2018-19 disclosing a total income of Rs.3,26,890/- and agricultural income of Rs.50,85,280/-. Against the said return of income, the assessment was completed by the National E-Assessment Centre, Delhi vide order dated 19.04.2021 passed u/s.144 read with section 144B of the Income Tax Act, 1961 at a total income of Rs.54,12,169/-. While doing so, the Assessing Officer made addition of Rs.50,85,280/- by disbelieving the agricultural income, as the appellant had failed to substantiate deriving of agricultural income.

4.

Being aggrieved by the assessment order, the appellant filed an appeal before the Learned CIT(A), who vide impugned order confirmed the action of the Assessing Officer by holding that the appellant had failed to substantiate the deriving of agricultural income despite several opportunities given by the Assessing Officer.

5.

Being aggrieved by the order of the Learned CIT(A), the appellant preferred an appeal before the Tribunal. At the outset, there is a delay of 372 days. The appellant had filed a petition seeking condonation of delay on the ground that as the appellant had deceased, the legal heirs of the appellant were not aware of the order passed by the Learned CIT(A) u/s.250 of the Act.

6.

We have perused the Affidavit and the averments made in the Affidavit. The averments made in the affidavit remain uncontroverted by Learned CIT-DR. The Hon’ble Supreme Court in the case of M.Kalappa Sethi Vs. M.V.Laxmi Narain Rao AIR 1973 SC 627, held that an uncontroverted affidavit shall be taken as an affidavit on fact. In the light of this legal position, we are of the considered opinion that the delay had occurred in filing the appeal on account of Bonafide reasons and the explanation cannot be brushed aside. Therefore, we are of considered opinion that there is a reasonable and sufficient cause for the delay, hence, the delay is condoned. Accordingly, we admit the appeal for adjudication on merits.

7.

On merits, the Learned AR submits that the agricultural income declared that same land was accepted by the Assessing Officer in the immediate preceding assessment year and therefore, the Assessing Officer ought not have disbelieved the agricultural income.

8.

On the other hand, the Learned Sr.DR opposed the above submissions.

9.

We heard rival submissions and perused the material available on record. We find from the record that the assessment order was passed ex-parte for the failure of the appellant to respond to notice u/s.143(2) of the Act. Even on appeal before the Learned CIT(A), the Learned CIT(A) confirmed the action of the Assessing Officer by holding that the appellant had not complied with the notice u/s.143(2) of the Act. We find that the appellant had deceased and the legal heirs perhaps may not be aware of the ongoing proceedings before the Assessing Officer as well as the Learned CIT(A). And therefore, considering the difficulties faced by the legal heirs of the appellant, we are of the considered opinion that the matter requires a remand to the file of Assessing Officer for denovo assessment in accordance with law.

10.

In the result, appeal filed by the assessee in ITA No.1977/CHNY/2026 stands partly allowed for statistical purpose.

ITA No.1978/CHNY/2026 : 11. Since the quantum appeal in ITA No.1977/CHNY/2026 restored to the file of Assessing Officer above, the penalty appeal of the appellant is restored to the file of Assessing Officer.

12.

In the result, appeal filed by the assessee in ITA No.1978/CHNY/2026 stands partly allowed for statistical purpose.

13.

To sum up, both appeals filed by the assessee stands partly allowed for statistical purpose. Order pronounced in the open Court on 24th August, 2026.
