In favour of the assessee: the Revenue's appeal was dismissed. From the AI summary of this appeal.

AI SummaryDismissed

What did the Tribunal hold?

The Tribunal held that once the addition for unsecured loans under Section 68 was deleted in an earlier year, the consequential disallowance of interest on those loans in subsequent years could not be sustained.

What were the facts?

Following a search, the Assessing Officer disallowed interest on unsecured loans treated as unexplained cash credits. The assessee argued that the addition under Section 68 for these loans was deleted by the Tribunal in an earlier year.

What were the issues?

Whether disallowance of interest on loans, where the principal amount was previously held to be genuine by the Tribunal, is sustainable. Whether the Assessing Officer can indirectly circumvent appellate findings by disallowing interest on loans whose genuineness is already adjudicated.

Which sections of the Income-tax Act were involved?

Section 68,Section 132,Section 153A
