Assessment framed without providing copy of reasons recorded is illegal and bad in law and be quashed. 3. That on the facts & circumstances of the case, assessment framed without providing copy of reasons recorded be quashed being opposed to judgment of Honorable Supreme Court in the case of GKN DRIVESHAFTS (INDIA) LTD. vs. INCOME TAX OFFICER & ORS 2003) 259 ITR 0019 wherein it has been held that on receipt of notice u/s 148 of the Act, the proper course of action for the noticee is to file return and if he so desires, to seek reasons for issuing notice. The AO is bound to furnish reasons within a reasonable time.
794-Chd-2025 3
That on the fact a & circumstances of the case, learned assessing officer has grossly erred in law in initiating proceedings u/s 147 of the Act since conditions for assumption of jurisdiction u/s 147 of the Act were lacking. in as much as, neither the reason to believe provide requisite nexus for the belief that income has escaped assessment nor there was any application of mind before assumption of jurisdiction. It may kindly be held that notice u/s 148 issued by the AO was illegal and invalid and consequent assessment framed u/s 144 r.w.s. 147/148 of the Act be held illegal and bad in law. 5. That on facts and circumstances of the case, Ld. Commissioner of Income Tax (Appeal) National Faceless Appeal Centre (NFAC) Delhi has grossly erred in law in confirming addition of Rs. 4,50,00,000/- made by Assessing Officer by simply observing that income of the assessee has escaped assessment to the tune of Rs. 4,50,00,000/-, Addition made is illegal and bad in law since no details whatsoever of Rs. 4,50,00,000/- have been given.
That on facts and circumstances of the case, Ld. Commissioner of Income Tax (Appeal) National Faceless Appeal Centre (NFAC) Delhi has grossly erred in law in confirming addition of Rs. 4,50,00,000/- since a) Documents relied upon to draw adverse inference against the assessee have never been confronted to the assessee. b) Assessee is neither aware of nature of documents in possession of the department nor is

aware about the source of those documents by the department. 7. That on facts and circumstances of the case, assessment framed is illegal, bad in law and void ab-initio since virtual hearing through video conferencing has not been granted inspite of request to this effect by the assessee. 8. That the Appellant requests for leave to add or amend the grounds of appeal before the appeal is heard or disposed off. 3. At the outset, ld. Counsel for the Assessee submitted that the CIT(A) has confirmed the addition made by the Assessing Officer without confronting the documents relied upon and drawn adverse inference against the Assessee of which the Assessee was neither aware of the nature of documents in possession of the Department nor the source of those documents relied upon by the Department. Further the Assessee was not granted opportunity for hearing through video conferencing though a request was made in this behalf by the Assessee. Therefore, the addition made by the Assessing Officer and confirmed by the Ld. CIT(A) is illegal and bad in law. It has also been submitted that the Assessee has a fair case

on merit. A prayer has, therefore, been made to remand the matter back to the lower authorities.
Per contra, Ld. DR relied on the orders of the authorities below.
We have considered the findings given by the Ld. CIT(A) in the appellate order and by the Assessing Officer in the assessment order and also the arguments made by the ld. Counsel for the Assessee as well as the ld. DR. From the findings of the Ld. CIT(A), it is observed that the Ld. CIT(A) has confirmed the addition made by the Assessing Officer without confronting the relevant documents to the Assessee relied upon by the Department. This fact has not been controverted by the Revenue. Furthermore, we find that in the present case, the request made by the Assessee for hearing through video conferencing had not been acceded to. Therefore, in the interest of natural justice and fitness of things we are of the view that Assessee deserves an opportunity of being heard in the matter.
794-Chd-2025 6
Accordingly, the matter is remanded back to the CIT(A) for adjudication afresh on merit after considering the submissions of the Assessee and material available on record. Needless to say, that the ld. CIT(A) will give proper opportunity to the Assessee to present his case and to furnish necessary evidences and details. The Assessee is also directed to present its case before the Ld. CIT(A) as and when called for and will not contribute in unnecessary delay in the hearing of the appeal.
