PER SHRI BALAKRISHNAN S, ACCOUNTANT MEMBER: This appeal filed by the Assessee are against the orders of the Commissioner of Income Tax (Appeals)/National Faceless Appeal Centre (NFAC), Delhi [in short, 'CIT(A)'], vide DIN DIN & Order No : ITBA/NFAC/S/250/2025-26/1083174867(1) dated 01.12.2025, arising out of the order passed under Section 143(3) r.w.s 144B of the Income Tax Act (the Act) dt 18.03.2024 for the Assessment Year 2022-23.

2.

Briefly stated the facts are that the assessee is carrying on the business of transportation in the name and style of the of M/s Sri Veerabbhadreshwara Transport, Hospet.

3.

The assessee filed the Return of Income for AY 2022-23 on 22.10.2022 declaring total income of Rs. 1,30,35,710/-. The case of the assessee was selected under CASS with the main scrutiny parameter as follows:

- Lower amount disallowed u/s 40(a)(i) in ITR in comparison to default found u/s 200A as per data received from CIT (CPC-TDS) - Substantial payments shown to entities not registered under GST. 4. A notice u/s 143(2) dt 02.06.2023 was issued and served on the assessee. Subsequently notice u/s 142(1) of the Act dt 28.08.2023 and 23.02.2024 was issued to the assessee calling for details. Assessee partly responded. Thereafter Show Cause Notice (SCN) dt 10.03.2024 was issued to the assessee. The assessee did not comply to SCN. Ld AO thereafter based on the material available on record disallowed a sum of 6,66,032/- being 30% of Rs. 22,20,105/-, due to non deduction of taxes at source under section 40(a)(ia) of the Act. Further the Ld AO after perusing the Tax Audit Report also disallowed a sum of Rs. 1,79,47,707/- being 4% (estimated based on profit declared by assessee) of Rs. 44,86,92,670/- with respect to the payments made to entities not registered under GST.

5.

On being aggrieved by the order of the ld AO, the assessee carried the matter in appeal before Ld. CIT(A). Since the assessee allegedly not responded to the notices issued, the Ld CIT(A) upheld the order of the Ld AO.

6.

On being aggrieved by the order of the Ld CIT(A) the assessee is in appeal before us by raising the following grounds:

1.

The Order of the learned Commissioner passed under section 250 of the Act is opposed to law, equity, weight of evidence, probabilities and the facts and circumstances in the Appellant's case.

2.

The Appellant denies to be assessed for income of RS. 3,16,49,449/- as against the declared total income of Rs.1,30,35,710/- on the facts and circumstances of the case. 3. The learned Commissioner of Income-Tax (Appeals) erred in law in passing the order without providing sufficient opportunities of being heard thus violating the principles of natural justice in the facts and circumstances of the case. 4. The learned Commissioner of Income-tax(Appeals) ought to have held that the learned Assessing officer grossly erred in upholding the disallowance of RS.6,66,032/- under section 40(a)(ia) without considering the facts of the case and details submitted by the appellant in the facts and circumstance of the case. 5. The learned Commissioner of Income-tax (Appeals) erred in upholding the disallowance of Rs.6,66,032/- under section 40a(ia) of the Act despite the Payee has fulfilled all the conditions mentioned in the first proviso of section 201(1) of the Act in the facts and circumstances of the case. 6. The learned Commissioner of Income-tax (Appeals) erred in upholding the addition of Rs. 1,79,47,707/- against the payments of Rs.44,86,92,670/- merely because the said payments were made to the entities are not registered under GST in the facts and circumstances of the case. 7. The learned Commissioner of Income-tax (Appeals) erred in upholding the addition of Rs. 1,79,47,707/- despite the appellant being duly paid the GST and submitted the GSTR Form 9C in the facts and circumstances of the case. 8. The learned Commissioner of Income-tax (Appeals) ought to have held that the penalty proceedings initiated u/s 270A of the Act is contrary to law on the facts and circumstances of the case. 9. Without prejudice to the right to seek waiver with the Hon'ble CCIT/DG, the appellant denies himself liable to be charged to interest u/s. 234A, 234B of the Act, which under the facts and in the circumstances of the appellant's case deserves to be cancelled. 10.The Appellant craves leave of this authority to add, alter, delete or substitute any of the grounds urged above. 11.In the view of the above and other grounds that may be urged at the time of the hearing of the appeal, the Appellant prays that the appeal may be allowed in the interest of justice and equity.

7.

Ground Nos 1,10 & 11 are general in nature and needs no adjudication.

8.

Vide ground No 3, the assessee has claimed that the Ld CIT(A) has not provided sufficient opportunities to file submissions. The Ld AR submitted that the assessee has uploaded evidences on 26.10.2023 before the Ld AO and on 19.04.2024 before the CIT(A). These submissions were overlooked by the Revenue authorities. The Ld AR also submitted that the Audit report submitted clearly indicates that there are no transactions on which TDS was not deducted. The Ld AR further submitted that form GSTR 9 and 9 C were also furnished before the revenue authorities. He also further submitted that the assessee has already declared profit at 3.8% and once again making an addition of 4% on the payments to entities unregistered under GST is not justifiable. He therefore prayed that the order of the Ld CIT(A) be set aside and the issues be remanded back to Ld AO to examine and consider the submissions of the assessee.

9.

Per Contra Ld DR relied on the orders of the revenue authorities.

10.

We have heard the rival contentions and perused the material available on record. It is an admitted fact that the Ld AO and the Ld CIT(A) has not considered the submissions made by the assessee during the relevant proceedings alleging non compliance by the assessee. The Ld AR has submitted the acknowledgement of the submissions uploaded in the ITBA portal. However, the lower authorities have not perused the submissions alleging non compliance. In the light of facts discussed above we find merit in the arguments of the Ld AR. Therefore, considering the prayer of the Ld AR, following the principles of natural justice, we find it deemed fit to remand the matter back to the file of Ld AO to examine the submissions and provide opportunity of being heard to the assessee, and decide the issue in accordance with law. Accordingly, the ground No 3 raised by the assessee is allowed statistically. Since ground No 3 has been adjudicated by remanding the matter back to the file of the Ld AO, other grounds raised by assessee on merits are dismissed as infructuous.

11.

In the result, appeal of the assessee is partly allowed statistically.

Pronounced in the open court on the date mentioned on the caption page.
