MARIAPPAN RAJENDRAN,THIRUVARUR vs. THE INCOME TAX OFFICER, WARD - 1, THIRUVARUR
What did the Tribunal hold?
The Tribunal dismissed the assessee's appeals, noting the assessee's non-serious approach and failure to participate in proceedings. The penalty under Section 272A(1)(d) was upheld as it pertains to non-compliance with statutory notices and is not dependent on the outcome of the quantum appeal.

Whether the penalty imposed for non-compliance with statutory notices is sustainable when the assessee claims reasonable cause due to COVID-19 disruptions, and whether the penalty is linked to the outcome of the quantum appeal.

Section 142(1),Section 148,Section 272A(1)(d),Section 273B,Section 147,Section 144,Section 144B,Section 69A,Section 271AAC(1)

ITA 2183/CHNY/2026
The brief facts of the case are that the assessee was amongst the non-filers of return u/s. 139 of the Act. However, during A.Y. 2018-19, as per information available with the Department, assessee has entered into the following financial transactions during the F.Y.2017-18, the details of which are as follows:-
Information Description Amount (in Rs.) Cash deposits in one or more accounts (other than a current account and 10,33,800/- time deposit) in Indian Bank Cash deposits in one or more accounts (other than a current account and 8,86,32,082/- time deposit) in the Laxmi Vilas Bank Ltd. In view of the above, a notice u/s. 148 of the Act was issued vide dated 04.04.2022, but the same was also not complied by the assessee. It is observed that the assessee never participated in proceedings against the notices issued to him vide para 2 of the assessment order. Ultimately, the case of the assessee was assessed after making addition of Rs. 8, 96, 65, 882/- u/s. 69A of the Act, u/s. 147, 144 r.w.s. 144B of the Act vide dated 05.03.2024. The AO in parallel initiated penalty proceedings u/s. 272A (1) (d) and 271AAC (1) of the Act and passed the penalty order u/s. 272A (1) (d) of the Act vide dated 02.09.2024. The assessee being aggrieved with the same preferred an appeal before the Ld. CIT (A) vide dated 24.11.2024, i.e. belatedly and the same was time barred by one year and 24 days. The Ld. CIT (A) dismissed the appeal of the assessee on technical ground that the assessee was failed to cover his case under the provisions of section 273B of the Act. The assessee being aggrieved preferred the present appeal before us.
It is observed that the assessee never participated before the authorities below and seems to be non-serious and casual in his approach. The appeal filed before us is also time barred by 16 days. As the penalty u/s. 272A (1) (d) of the Act Mariappan Rajendran pertains to non-compliance of statutory notice issued u/s. 142(1) of the Act, hence, the same cannot be deleted until unless the assessee is able to make out the case u/s. 273B of the Act. In this case, the Bench is not aware of the outcome of quantum appeal, if any. Nevertheless, as per the provisions of law the penalty u/s. 272A (1) (d) of the Act is not related with the outcome of quantum appeal and as discussed and observed (supra) the assessee never participated in any of the proceedings before the authorities below and before us also, the grounds raised by the assessee are dismissed.
In the result, the appeal of the assessee is dismissed with the above observations.
ITA 2184/CHNY/2026
The facts of this appeal are similar to ITA 2183/CHNY/2026, hence, there is no need to repeat the factual observations and background of the case. Although, the penalty u/s. 271AAC (1) of the Act as a direct nexus with the quantum appeal and as mentioned (supra), this bench is not aware of the outcome in quantum appeal, if any. In view of this, considering the facts and observations discussed (supra), the ratio as laid down in ITA 2183/CHNY/2026 will apply mutatis mutandis here also with an exception that if the assessee is able to demonstrate any variation in his favour in quantum appeal, the amount of penalty as calculated u/s. 271AAC (1) of the Act will also be changed accordingly. In view of this, the ground raised by the assessee are dismissed.
In the result, the appeal of the assessee is dismissed with the above observations.
