INDIAN SQUASH PROFESSIONAL, MUMBAI vs. COMISSIONER OF INCOME TAX EXEMPTION, MUMBAI
What did the Tribunal hold?
The Tribunal restored the matter to the CIT (Exemption) for fresh consideration. The CIT is directed to verify the assessee's prior registration and decide the application afresh after the assessee furnishes the required documents and is given a reasonable opportunity of hearing.
What were the facts?
The assessee trust applied for regular registration under Section 12AB of the Income-tax Act. The CIT (Exemption) rejected the application because the assessee failed to furnish a copy of its registration certificate granted prior to April 1, 2021, under the old regime.
What were the issues?
Whether the CIT (Exemption) was justified in rejecting the application for registration under Section 12AB solely on the ground of non-furnishing of the prior registration certificate without granting an opportunity to produce it.
Which sections of the Income-tax Act were involved?

Before: SHRI AMIT SHUKLA & SHRI GIRISH AGRAWAL
आदेश / O R D E R PER GIRISH AGRAWAL (A.M): The present appeal has been preferred by the above- named assessee trust against the order dated 22.02.2026 passed by the learned CIT (Exemption), whereby the application filed by the assessee in Form No. 10AB seeking regular registration under section 12AB of the Income-tax Act has been rejected.
2 ITA No.4554/Mum/2026 Indian Squash Professional
We have heard the rival submissions and perused the material available on record. The sole reason assigned by the learned CIT (Exemption) for rejecting the assessee’s application is that, though the assessee had claimed itself to be an existing trust registered under the erstwhile provisions of the Act, it had not furnished the copy of the registration certificate granted prior to 01.04.2021 under the old regime. Accordingly, the learned CIT (Exemption) proceeded to reject the application.
Before us, the learned counsel submitted that the assessee is an old charitable trust and the rejection is merely on account of non-furnishing of the earlier registration certificate. It was submitted that the assessee is in a position to furnish all the requisite documents, including the registration certificate under the erstwhile provisions, if one effective opportunity is granted. It was thus contended that the application deserves to be reconsidered on merits after verifying the relevant records.
Having regard to the facts and circumstances of the case, and following the view consistently taken by the Coordinate Bench in other similar matters involving identical facts, we deem it appropriate to restore the matter to the file of the learned CIT (Exemption). The learned CIT (Exemption) shall
3 ITA No.4554/Mum/2026 Indian Squash Professional verify the registration held by the assessee under the erstwhile provisions of the Act and, upon the assessee furnishing the requisite documents and satisfying the statutory requirements, decide the application afresh in accordance with law after affording a reasonable opportunity of hearing. The assessee is also directed to extend full cooperation and furnish all the documents and details as may be called for during the course of the fresh proceedings.
In the result, the appeal of the assessee is allowed for statistical purposes.
Order pronounced on 29th June, 2026.
