What did the Tribunal hold?

The Tribunal held that the assessee did not file a fresh return in response to the notice u/s 148, thus the notice u/s 143(2) could not be generated. Regarding the merits, the Tribunal upheld the CIT(A)'s direction to verify the short-term capital loss as no substantiating material was provided by the assessee.

What were the facts?

The assessee's case was reopened based on information that the assessee had availed accommodation entry for bogus long-term capital gain/loss. The Assessing Officer treated a short-term capital loss of Rs. 3,25,511/- as bogus and made an addition. The CIT(A) dismissed the legal grounds but set aside the matter to the AO for verification of the grounds on merits.

What were the issues?

Whether the reassessment proceedings were valid without a fresh return filed in response to notice u/s 148 and subsequent notice u/s 143(2)? Whether the short-term capital loss claimed by the assessee was substantiated?

Which sections of the Income-tax Act were involved?

Section 144,Section 147,Section 148,Section 143(2),Section 143(3),Section 234A

Before: MS SUCHITRA KAMBLE & SHRI NARENDRA PRASAD SINHA

For Appellant: Shri Hemanshu Shah, CA

Hearing: 19.05.2026Pronounced: 14.07.2026

PER NARENDRA PRASAD SINHA, ACCOUNTANT MEMBER:

This appeal is filed by the assessee against the order of National Faceless Appeal Centre (NFAC), Delhi [hereinafter referred to as “CIT(A)”] dated 17.11.2025 for the Assessment Year (A.Y.) 2012-13 in the proceeding u/s 144 r.w.s. 147 of the Income Tax Act [hereinafter referred as “the Act”].

2.

The brief facts of the case are that the assessee had filed his return of income for A.Y. 2012-13 on 31.07.2012 declaring total income of Rs.1,20,000/-. The original assessment was completed u/s. 143(3) of the Act on 24.03.2015 as per return income. Thereafter, the case of the

assessee was reopened on the basis of information received by the AO that the assessee had availed accommodation entry in the form of bogus long-term capital gain/loss. There was no compliance by the assessee in the course of re-assessment proceeding. The AO had treated the short- term capital loss of Rs. 3,25,511/- in the scrip Prerna Infrabuild Ltd., as bogus and accordingly made the addition.

3.

Aggrieved with the order of the AO, the assessee had filed an appeal before the first appellate authority, which was decided by the Ld. CIT(A) vide the impugned order. While dismissing the legal grounds taken by the assessee, the Ld. CIT(A) had set aside the matter to the file of the AO to verify the grounds taken on merits. h

4.

Now the assessee is in second appeal before us. The following grounds have been taken in this appeal:

1.

In law and in facts and circumstances of the Appellant's case, the learned Commissioner of Income-tax (Appeals) has erred in points of law and facts. 2. In law and in facts and circumstances of the Appellant's case, the learned Commissioner of Income-tax (Appeals) has grossly erred in confirming issue of notice u/s 148 of Income-tax Act. 3. In law and in facts and circumstances of the Appellant's case, the learned Commissioner of Income-tax (Appeals) has grossly erred in not deciding ground for furnishing reasons for reopening assessment resulting into invalid of reassessment order. The reassessment is invalid, illegal and abinitio void. 4. In law and in facts and circumstances of the Appellant's case, the learned Commissioner of Income-tax (Appeals) has grossly erred in confirming assessment order passed u/s 144 r.w.s. 147 of Income-tax Act. 5. In law and in facts and circumstances of the Appellant's case, the learned Commissioner of Income-tax (Appeals) has grossly erred in setting aside the issue of disallowance of Short Term Capital loss of Rs.3,25,511/- to Assessing Officer for verification.

6.

In law and in facts and circumstances of the Appellant's case, the learned Commissioner of Income-tax (Appeals) has grossly erred in setting aside the ground of not setting off of current year business loss against addition/disallowance made in the assessment to the Assessing Officer, for verification. 7. In law and in facts and circumstances of the Appellant's case, the learned Commissioner of Income-tax (Appeals) has grossly erred in setting aside the ground of assessing total income at Rs. 56,86,597/- to the Assessing Officer for verification. 8. In law and in facts and circumstances of the Appellant's case, the learned Commissioner of Income-tax (Appeals) has grossly erred in not considering the fact that no notice u/s 143(2) of I.T. Act was issued against return of income filed in response to notice u/s 148 of Income-tax Act. 9. In law and in facts and circumstances of the Appellant's case, the learned Commissioner of Income-tax (Appeals) has grossly erred in not considering the fact that interest u/s 234A of IT. Act was wrongly levied because return of income in response to notice u/s 148 of 1.T. Act was filed within due date of notice u/s 148 of Income-tax Act. 10. In law and in facts and circumstances of the Appellant's case, the learned Commissioner of Income-tax (Appeals) has grossly erred in dismissing ground of raising demand of Rs.25,34,850/-. 11. Your appellant reserves the right to add, alter, amend all or any of the above grounds of appeal as may be advised from time to time. . 5. We have heard Shri Hemanshu Shah, the Ld. AR and Shri Rajeev Garg, the Ld. SR-DR. We do not find any merit in the legal grounds taken by the assessee in the present appeal. The reason for reopening was duly provided to the assessee. The Ld. AR has vehemently argued on the issue of no notice u/s. 143(2) of the Act being issued by the AO in pursuance to notice u/s. 148 of the Act. It is found that the assessee did not file any return of income in response to notice u/s. 148 of the Act. The assessee had merely stated that the return filed earlier on 31.07.2012 should be taken into consideration for compliance to the notice u/s. 148 of the Act. As per the scheme of e-filing of return, the assessee had to file a fresh return u/s. 148 of the Act on the Departmental portal, which was not done

ITA No. 16/Ahd/2026 Babubhai Ramanbhai Patel Vs DCIT, AY- 2012-13 4 by the assessee. The notice u/s 143(2) is generated by the Systems only when a return u/s 148 of the Act is filed on the e-filing portal. In the present case, no return was e-filed by the assessee in response to notice u/s. 148 of the Act. In the absence of any such return, the notice u/s. 143(2) of the Act couldn’t have been generated and issued to the assessee. Hence, the ground taken by the assessee in this respect is dismissed.

6.

As regarding merits of the case, the only contention of the assessee is that he was eligible to set-off of short-term capital loss of Rs. 3,25,511/- with the other income of the current year. The AO as well as the Ld. CIT(A) have given a categorical finding that no material was brought on record by the assessee to substantiate the short-term capital loss of the current year. The Ld. CIT(A) had, therefore, set aside the matter to the file of AO with a direction to verify the short-term capital loss and thereafter allow the claim of set-off, as per law. We do not find anything wrong with the direction of Ld. CIT(A). The matter is still open for the assessee to substantiate the short-term capital loss before the AO in the set aside proceeding. The assessee has not controverted the finding of the Ld. CIT(A) regarding non-submission of evidence in respect of short-term capital loss. Therefore, the direction of the Ld. CIT(A) for setting aside the matter to the file of AO for verification of short-term capital loss/other business loss, is upheld. The ground taken by the assessee in this respect is dismissed.

7.

The other grounds taken by the assessee are only consequential in nature. Hence, the same are dismissed.

8.
